    Hi Matt - last action from our end was a request for more information from us from the conveyancer on 10th June. As yet we haven't received a reply.
    Hopefully your conveyancer can confirm and clarify when they expect to be able to respond in full to that request
    If by 'we still haven't heard anything' you mean the conveyancer as well and they don't have our request of the 10th please ask them to contact us through their normal direct and secure channel to clarify

    I have just spoken to my solicitor and she says they replied to your request on the 20th June via the reply to requisition portal ref ICBBD42?

    Can you confirm that you have recieved that reply? She says there were 4 points that needed to be confirmed and all 4 were confirmed.

    ICBBD42 relates to a second and attached application (transfer of part) lodged by the same firm. Their reply of the 20th was to a request raised on 18th June
    The application I was referring to was ICBBD40 (the new lease) and a request dated 10th June which has 6 request points

    Hoping you can help us @Land_Registry as we're stuck!

    We are in a very time-sensitive transaction as our vendors are emigrating to Australia and they are effectively dictating the timeline.

    We've been waiting for about a month for our vendor to send our solicitor their title. After our own research we have found the title is 'pending Transfer of Part'.

    The vendors are the first owners of a new build back in 2021. Nothing fancy or complicated, just a house with garden.

    By using the Land Registry tool, I can see all the other neighbours on the street have titles available to download. When I search our vendor, it comes back with 'We cannot show information for...'.

    The only information we have is 'the seller's title is being expedited at the Land Registry'. However we're not sure what exactly is being expedited.


    Questions I'd be grateful if you could answer:

    1. What would the reason be for a 'pending Transfer of Part'?
    2. If they have indeed expedited registration, how long can we expect this to take?
    3. Is there anything we should be worried about?

    Sorry to read of the issues being faced
    1. The application has yet to be processed - we do have delays but without the specifics it's unclear what's happening
    2. Expedition gets you to the processing start line. It's not a magic wand but generally speaking should ensure it's processed within a couple of weeks of being expedited. Everything then hinges on it being in order and/or no other pending applications against the seller's title prevent it from being completed
    3. Impossible for us to answer - a Q for your conveyancer and not us. I would suggest pressing the conveyancer for an update to establish not only the provisional title number but also an idea as to what's pending and whether processing has started/been delayed for any reason

    Apparently a Transfer of Part request was put in with a 'priority date' of 14 September 2023, which is odd since the vendors moved in early 2021.

    Application progress is 'Delayed prior pending applications or official search requisitions issued on 13 June 2024'.

    Are you able to translate the above or dig deeper to help us better understand where things are?

    Those details relate to a Plot 32 which as you state completed in March 2021. The current application to register was submitted in Sept 2023 and then expedited and partially processed. Two previous attempts to register had failed as both were incomplete.
    The current application is also incomplete and we are awaiting a response form the conveyancer to remedy matters. We contacted them on 13th June as stated and have done so again on 26th June so the ball is very much in their court to respond to enable us to complete the registration

    We are in the process of completing an application for adverse possession of an unregistered plot of land which adjoins our own. We are doing so without the help of a conveyancer and believe we need to complete forms FR1, ST1 and two copies of DL, alongside supporting plans/evidence. We are stuck on panels 14, 15 and 16 of form FR1 which relate to ‘evidence of identity’ - we have read ‘Practice Guide 67’ as advised on the form but are still not sure whether our application, which we think counts as a voluntary first application for unregistered land, warrants an exemption. 

    We believe we need ignore panel 15 (since we are not conveyancers) and complete panel 16 writing ‘none’ in the righthand column (‘conveyancer’s name…’ etc) but we are unsure if we actually need to provide evidence of identity as requested in part 2 of panel 16? ‘Practice Guide 67’ details possible exceptions to the requirement for ID and these include “7. Voluntary application for first registration where the title documents have been lost or destroyed.”… but what about if no title documents are known to have existed? As far as we know, the plot of land has never been owned/registered and there are no documents relating to it. We have searched online for title plans/details for that piece of land but cannot find anything. 

    If evidence of identity IS required for our application - please can I confirm that this needs to be provided by form ID3?

    There are no identity requirements re an application for first registration based on adverse possession
    Don't forget you also need your statement of truth to set out the 'facts'  - see our PG 5 for guidance
