    I am buying a property with a historic rent charge that HSBC are refusing to mortgage unless we redeem the rent charge. It has now been paid off, so its just getting that officially recognised for HSBC.

    If I were to privately get a Deed of Release to show that the rent charge has now been paid off, would you accept that as enough to change the title deed?

    Typically you ask for a Redemption Certificate but I have been told a Deed of Release may work instead as the waiting times are too long with Redemption Certificates?
    A deed of release can be acceptable if it does what it intends

  • We've just received this letter from HM LR. Apart from the name and address (which II've redacted) it's complete gobbledegook!

    It came with another letter which was legible telling us that an original document was being returned, the document was also enclosed.
    Are you able to find out what this letter was about for me? It's a voluntary first registration, title #SL273743

    I am in the process of purchasing a property which had a historic rent charge. My solicitors asked for evidence of this or for it to be brought out before we can exchange as this was the final part required.

    The sellers have contacted the company who owned the rent charge and have brought it out. With this they were provided a Rentcharge Redemption Certificate from the company. 

    However, my solicitors are now asking for the previous rent charge holders (Shenstone Properties) to provide Evidence Of Title. I assume this is a certificate stating that they previously held ownership of the rent charge. The issue is, Shenstone are simply not responding, or providing the correct certificate. We have been on this issue for 2 months. 

    I have read online that the Rentcharge Redemption Certificate should be enough to remove this from the Land Registry, and additional Evidence Of Title is not required. Could you clarify what is fully required to remove the rent charge from the register?

    I’ve had a property alert pop up that an application has been lodged on my property which I was not expecting. I am changing mortgage deal (but not provider) in March but the company lodging are “NWJ Legal”. Is this likely to be mortgage related or something I should call LR about? Thanks.

    A redemption certificate is generally sufficient providing it’s from the rentcharge owner. If there’s any doubt then more will be needed to show how the redeeming company now own the rentcharge and can therefore redeem it. Do rely on your solicitor here

    You should contact NWJ Legal if you are not aware of anything that would involve an update to the register. The alert explains what to do in such cases.

  • Hi LR.

    How long should we expect to wait, as buyers for "Land Registry pre-completion checks"? I believe these are to check there are no charges against the titles being transferred. One title is a whole whilst another is a transfer of a part. My solicitor told me at the start of the week that they're usually instant, but transfer of a part "can take a few days". From what they're telling me, they're still not back today. We were meant to exchange today but it's blocked waiting for these which apparently "can't be expedited or chased".

    To be quite honest, I'm not sure these were ordered when I'm being told they were, just wanted to get an idea of max timelines. Thanks.
