  • I’ve posted a new thread but just found this:

    Please can someone help, we are near the end of purchasing a flat, typically the solicitors have been really slow, now our solicitor is saying the the Title Register has a different address on it (old address), however in 2015 it looks like the address and postcode were changed,  no one recognises the old postcode as it looks to be obsolete. The solicitors say the mortgage must match the title register, our mortgage brokers says the whole application will need to be redone and the fixed rate we were on has moved up 0.5%, it was a real struggle to get a mortgage and we can't risk trying to get a new one, plus the broker is saying how can he process a mortgage application on an address that no longer exists. 

    Ideally, we want the sale to proceed and sort out the LR title register later and pay any fees to do it, it's very odd as the title plan shows the new building number and title register shows the old!!

    The solicitors is saying it could take ages to correct and costs will be passed to us, we want to ditch this solicitors and use someone else for further work, can anyone offer help on how we can proceed using our current mortgage offer and just get the sale over line and deal with Land registry later, solicitor saying we can't do that, but not offering any real hlep how to progress.         
    Unsure anyone likely to offer wider help on this thread. But has anyone contacted us to get the registered details amended? If they have what’s the title number?

    Thanks for the reply, I thought it would simply be a case of calling LR and getting it amended, however our solicitor is saying that they need to approach the local authority and then LR, the say this will take time and cost us. I can't see why this would be the case as we are not changing the name, it was done in 2015 by Royal Mail. Is it not the case that the vendor just need to contact LR and get it changed or can our solicitor simply put the new address on the TR1 form and the register will update anyway? We just want to get the sale complete as our landlord is giving us grief, can we proceed making the LR changes after we take ownership?  I tried to login into the LR website using the old postcode, it doesn't accept it, it does accept the new one, so everything is fine and it just our solicitor holding up things. The building is on a corner the the old and new address are adjacent roads with different building number, road and postcode but right next to each other.

    If the LA are involved then there’s an issue with the actual address. The LA manage postal addresses as they maintain the electoral register. 
    Our online service will use the ‘current’ address data so it would match but it reads as if the register doesn’t as that’s the issue here.

    Thanks, I've sent a DM, the old address is not recognised by the electoral register, new address works fine. We just want to know that we can safely get it changed after the sale or if the register gets updated with the new address once we take ownership. thanks

    I purchased a leasehold flat in August 2018. The seller extended the lease with the freeholder just weeks before selling, but the leasehold term has not been updated on the property register. Who is responsible for filing this update with land registry? Should it have been my solicitor, the freeholder or the seller? The property title number is NGL444803.
    Can you offer any advice on the best way forward?

    Yesterday (11th January) our solicitor submitted a priority search of part for a purchase we are about to complete on. Reference: U8LQVNC.

    This is the final thing we need returned in order to complete, which we are hoping to do tomorrow. Is there any way we can check on the status of this application, or ask for it to be expedited?

    Possibly. However, last time we found ourselves inadvertently buying an unregistered property, where the owner/occupier had bought the property new, hadn’t bothered registering and the deeds were lost, I’m pretty sure that the wording of the LR search engine’s response was different.
    Deeds are recorded electronically which the buyers solicitor sends the relevant document to LR.
    Not sure how they can be lost.. they must have had a completion statement  or solicitors would have kept a copy.

    However to your last request it is more than likely the property hasn't previously been sold and not on the electronic version so paper deeds will need to be found.

    POA's will normally take over if a relative has succumbed to a nursing home if that has been arranged so the only way you will really know is going through the process of buying and asking the vendors solicitor 
    Thanks for that. I asked the EA to contact the vendors and ask whether they could clarify the absence of title deeds, but I got the distinct feeling that she considered such enquiries to be beyond her pay grade.

    In the meantime a cash buyer has come along and had an offer accepted on the property, so good luck to them. .

    If it was extended and then you bought it’s less about whose responsible but all about making sure both are applied for and in the right order. If you bought then your conveyancer would normally either agree the seller apply to register the extension before you then apply to register your purchase. Or you do both. 

    Looking at the title history it looks like the same conveyancer made the 2 applications but a few weeks apart. So that must be your conveyancer 
    Unfortunately the lease extension was rejected as the application form was incomplete. So the later purchase was registered without the lease being extended
    Suggest you speak to your conveyancer and ask them to check/confirm and then apply to update the register as appropriate .
