Hi. I am after some advice if anyone can help. I currently own an equestrian property with my mother. I have recently just had planning permission to convert one of our outbuildings on the yard into residential (this will be my living accommodation).
Our property is mortgage free and I am looking into the best way to finance the build. My mother is now 72yrs old and I do not want to remortgage our house to pay for this. We have discussed splitting the deeds on the property so she owns the house and garden. I will own the land, yard and its access on the other deeds. I can then take out a self build mortgage on my deeds and she can remain mortgage free on the house and will have options to have equity out or move etc in the future if she wishes.
Is it possible to split the titles and if so how do I go about doing it?

Do you plan to keep the property, or sell it? If to sell, do not transfer into your names.
However, when my parents purchased the property (no mortgage), it was registered solely in my mother's name. Unfortunately, my mother passed away in 2011 - she left a will leaving everything to my father - and he continued to live in the marital home, although I am aware that he never transferred the property into his name.
As I've mentioned, my father passed away in June this year, and I am looking for some advice/guidance on how I go around having the deeds transferred into myself and my siblings names, when it will all still be in the name of my late mother?

Unfortunately you’re going to need to get a grant of probate for your mums estate. You can though then transfer the property directly to yourselves if that’s what you want to do.0 -

Completely possible. You’ll need 2 x TP1’s, 2 x plans (one showing the extent of the title to be transferred to you in your sole name and one showing the extent to be transferred to your mum in her sole name). You’ll also need AP1 and ID1.
Given that this could be complex and getting it wrong could devalue the development land (i.e. if you don’t reserve or grant the required easements etc) I would recommend that you speak to a solicitor who specialises in this area.0 -

At the moment, we are not looking to sell the property - as one of my brothers who had lived with my father since my mother passed away, is currently living in the house. Although it is doubtful that he will want to stay in the house long term - so in that case we would be looking to sell.

You’ll need probate for your late Mother as well. As that presumably names your late Father as her personal representative then it plus your Letters of A create what is known as a chain of representation.
The personal representative of your late a Father can then transfer the property to the beneficiaries“Official Company Representative

As you want them in separate names then they can be transferred as such. As already posted form TP1 and AP1 and ID1s to transfer a part to a sole name.
If you want the remaining part to be in a sole name then TR1 can be used to transfer the whole of the residue as well.
The transferred part would get a new title whilst the retained part is simply transferred from joint to a sole name.
So TP1 and TR1 in that order seems the way to go“Official Company Representative

What do you mean by information in this context?
If the property is registered then the title number will confirm those details for you. So I assume you are after something which is not included in the registered details.
For example if you want to know who is occupying the premises then we would not know unless they were the legal owner. So you may have to start with the legal owner and ask them for the information you are after“Official Company Representative
