    Hi please give any help as i am at a loss.My dad passed away in 2014 and the house was to be transfered to my name but it isnt showing my name in connection with the house in the land registry.The lawyer has assured me it is all done and has provided a letter stating this,i dont dispute that they did the work,just wanted to know what is the best way of getting the exact details,what site is the best to use and what would the cost be.Any help would be amazing.thank you

    You can download the title register from the Land Registry website (make sure you use the official .gov one). This will show you who owns the property as far as the Land Registry is aware. It is possible that the assent/transfer was completed but not registered. The failure to register would be u lawful but wouldn’t stop the transfer from having occurred.

    It is somewhat puzzling that you say that your name isn’t showing in connection with the Land Registry, as this would indicate that you have already obtained the relevant document or spoken to someone?

    This is the website you need:
    https://eservices.landregistry.gov.uk/


    Download the Title document for £3. This will show the registered owner.
    If as is likely the house is freehold, you need the freehold Title.
    If it is leasehold (less likely), ignore the freehold title and download the Leasehold Title.
    You do not need the Title Plan (another £3) unless you are interested in seeing where the boundaries of the property are.


    If your name does not appear as the registered owners, you need to go back to the 'lawyer', and/or the Executer(s) of your dad's Estate, and ask them exactly what they did eg complete an 'Assent' and send it to the Land Registry? What exact date?

    Hi

    I am buying a house and in part C Charges Register it has the following (in brief)

    1. conveyance of land in this tittle 1929

    2. (8.3.1977) Registered charge dated 2. February 1977 to secure the moneys including the further advances therein mentioned

    3. (12.11.2006) proprietor: Bank Of Scotland of Halifax Division

    I guess 1929 is when it was built and 1977 is when the person we are buying from bought it, What is the 12.11.2006 part? the current owner has lived in the property since 1977 but we dont know what the Bank Of Scotland bit is about?

    What is the 12.11.2006 part? ... but we dont know what the Bank Of Scotland bit is about?

    The different date (12.11.2006) will be because the bank have changed their name from the one used when the charge was registered (8.3.1977) 2 February 1977 is when the charge was loaned.

    Scotland has a separate registration system, you won't be able to access property in Scotland via that website
    Scotland is (I can't post links as a new user - even in quotes it seems) ros gov uk

    The deed transferring the property from the executor to you as a beneficiary probably isn't registered (because they don't have to be) - if you want that then ask the solicitor - who should also be able to provide a copy of anything else you want to see in the titles.

    As this is Scotland I'm not certain it works the same way, but in England/Wales a restriction should be applied for if you were not being registered as owner outright, but just a beneficiary.
    The restriction would appear in this form

    No disposition by a sole proprietor of the registered estate (except a trust corporation) under which capital money arises is to be registered unless authorised by an order of the court.

    If there is something similar on what you have, then you may not be registered as outright owner but your beneficial interest is perhaps what has been registered
