    Yes got the V5. I have gone back to DVLA (as my son) explaining he purchased the car last year and that we have the V5 and pay the tax monthly by direct debit. The V5 we have is the one given to us when we brought the car so in the previous owners name. Looks like we never did get a new one through :(

    ahh , you have a problem , the v5 you have is in the previous owners name?

    this could result in a nasty fine ,

    await others BUT I suggest the V5 is amended ASAP

    looks like the buyer and seller have not followed the correct procedures
    What the V5 changes mean when selling a car

    If you are selling a car, you still need to find your V5C logbook. Your buyer will want to scrutinise it, and once the deal is done you have to fill out the small section called V5C/2. It’s a small slip, but you must tear it off and give it to the new owner as proof of the transfer of ownership.

    Then, instead of filling in the rest of the relevant sections in the V5C logbook and sending the form to the DVLA through the post, you simply inform the DVLA online of your vehicle’s change of ownership.

    Once you’ve informed the DVLA of the changes to the keeper of the vehicle, you will receive an instant e-mail confirmation and a letter confirming the changes. If you sell your car to a dealer or motor trader, the procedure is exactly the same.
    the buyer should not have received the full V5C , just the tear off part , the v5c/2 section only (on the right hand page)


    the original owner and the buyer should have either filled in the left hand part to transfer ownership and posted off the V5C to the DVLA , or done the online transfer the DVLA brought in 2 years ago


    the one thing that isnt done is handing over the full V5C to the new owner

    I sent the letter off today and got proof of postage.

    As i contacted the debt collection agency yesterday, they come back to me today asking if i wanted them to refer my emall to First. I replied saying I had no legal right to contact them yesterday so therefore to not progress my email any further as my son is dealing with the matter. they told me that we should not try to contact First in anyway and if we do, they will tell us to liaise via the debt collector. Never in my emails did I confirm my son to be the driver, only the fact the NTK came to my son.

    DVLA have come back to me confirming that they never gave out my sons details as he is not down as the registered keeper. All I can think is that First contacted the registered keeper and he gave First my sons details.

    Good, so F1rst cannot hold him liable in law, partly because the NTKs were too late and partly because they did not get the keeper data from the Secretary of State (DVLA route). Both of which are prescribed in Sch4 of the POFA 2012, in order for keeper liability to come into play.

    All you need is 16 POPLA codes!

    Thank you. DVLA have advised us to complete the V62. We have part of the V5 but the seller kept the other to send back.

    correct, that is what the seller should have done , and only handed your son the small slip on the right hand side , to keep

    seems to me that people have not done this transfer properly, hence all this confusion

    but as FIRST did not get keeper details for your son from the DVLA , then their evidence is flaswed (mainly due to this not being transferred correctly last year)

    so as mentioned above, FIRST need to issue 16 popla codes, otherwise if this ends up as a court case its going to be worth watching the fallout over liability

    your son will know when the V5C is correct when he is sent a new one by the DVLA with his keeper details on it

    I am surprised that he got insurance when he is not the registered keeper

    We insured it before we picked it up so therefore it would make sense that it was in someone elses name. The insurance has been renewed since and the DD comes out my bank each month. I have completed the V62 and taking it to be posted now.

    Blimey, this is proving to be hard work!

    TBH this mistake (as long as the DVLA don't fine you for it) may be the best thing to have done! The F1rst PCNs are all non-POFA so a keeper can appeal all of them at POPLA and win. Maybe that's why F1rst ignored the appeal...no wish to issue 16 POPLA codes.

    We will see, and complain to the BPA if F1rst do not respond properly in August.

    Just looked, it seems the DVLA fine is £35 I will take that :) No excuse I know but my son spends a lot of time away at Uni, I have no clue when it comes to cars! So it has just escaped us that the certificate has not arrived.

    We purchased the car from a dealer. We have a receipt from the dealer however the bit of log book we have shows a name as another person.

    First have either got my sons details from Uni or by going to the previous keeper who has gone to the dealer.

    I will wait to see what response we get. What if they deny ever receiving my first letter? Is there a certain timeframe you get to appeal?
