"Why these individuals went to court and what advice they received is difficult to know"

Strange comment from Carwen Jones this. The individuals went to court because Indigo issued proceedings against them!

The Labour First Minister has now claimed that the parking "rules" have to be enforced because there was a death due to "illegal" parking at the hospital. http://www.bbc.co.uk/news/uk-wales-politics-40644807

I think it's clear that the English and Welsh establishment is happy with the situation of nurses having to pay £150,000 in parking tickets and this potentially hurts any hope with an appeal, because if the politicians are appealing to emotion like this then the Judges will no doubt follow their paymasters.

(Of course if there truly was a death due to "illegal parking" I doubt it was one of the defendants but RIP that person).

sorry missing something here , the "plonker" Carwyn Jones said it was "unfortunate" for them, but said the rules were introduced after a death on the site.

how can placing tickets on cars reduce the risk off death?

""But it's important that there is proper enforcement on the UHW site in terms of safety and to stop parking there all day, in order to make sure that patients who arrive on site do have places to park.""

fantastic comment , Umm , doctors and nurses work 12 hr shifts , its them that need the parking!

I would love to see , ever doctor/nurse who could not park , drive home and let management sort staffing out

the views of government ministers have now been stated , they do NOT care about staff .

There could well be many more deaths if doctors, nurses and other staff are now forced to park miles away and then find it difficult to get into work on time. Especially those on emergency call.

The court case aside, you would think that in the hope of restoring some degree of industrial harmony (and patient welfare), the hospital, and particularly the politicians, would be trying to find some way of arranging a form of parking to accommodate the staff, rather than casting them back into the clutches of Indigo and facing impossible decisions of either parking 'illegally', and soaking up more 'fines', or risking patients' lives!
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

During First Minister's Questions on Tuesday, Mr Jones told assembly members: "It's important I think that the reasoning behind the court case is understood.
"The reason why enforcement was put in place was because there had been a death on the site, partially due to illegal parking and partially due to the traffic flow going through the site.

Right, seeing as enforcement there was initially carried out by APCOA, years ago, Carwyn Jones needs to be asked to prove when that sad death was, whether it was immediately BEFORE any parking enforcement and of course, to explain how issuing fines to NHS Staff (and allegedly in 2017, repeatedly ignoring appeals and not issuing POPLA codes, so that Indigo have a clear path to sue even more people) avoids such sad events?

His first name is unfortunate, given this topic.

He can't possibly mean this far more recent sad event with a lorry at A&E (not in any car park) can he?

Nothing to do with staff car parking, then.

    This is more closely related:

    https://www.theguardian.com/society/2013/jul/26/wales-hospital-dangerous

It is dangerous to prevent sufficient staff from reaching the site in time for their shifts and dangerous to drive away your Doctors & Nurses...more delays...more gridlock inside than outside. Next they will be fining patients for sitting in the waiting room too long.

All the media spin is that 98% of staff park correctly and it's just a hardcore 2% who flout the rules and now they are responsible for people dying due to illegal parking as well.

The establishment has well and truly pulled ranks with this.
If you were not the driver write to the parking firm and tell them who was so they CANNOT hold you liable. The person who was driving the car is responsible so let them deal with it. Not you! Don’t let people with an agenda tell you otherwise.

Over £3000 now, that's more than 10% achieved already!

Kudos to Sue Prior and her tireless TV interviews to highlight the draining of money from NHS staff.

Just a quick tuppence-worth on this.
The hospital say there isn't enough land to extend the car park.
Don't they know about building upwards?
Multi story car parks are pretty common nowadays.

Multi story car parks are pretty common nowadays.

Two very large hospitals just outside Bristol were amalgamated. A new hospital unit was built at Southmead then the nearby former Frenchay hospital was closed and everything moved to the new build.
The problem was there wasn't enough parking at the new facility so the old car park was closed, a park and ride was used from the grounds of Frenchay as well as renting a car park from the local aerospace welfare association.
The old car park was then dug up and a new multistorey was put up.
It was chaos for a while whilst this was done, but the end result is a new hospital and more than adequate parking at the new facility. It's pay and display but all the money goes to the hospital trust to recover the cost of the new car park.

All this is eminently possible at Cardiff; it just needs someone who can think and plan. A lease can be ended early by the landowner especially if the original leaseholder is no longer operating there. Alternatively compulsory recovery of the land by the landowner is possible by using local or national government legislation.

Perhaps the people at Cardiff should talk to the people at Southmead to see how it could and should be done.
