Currys PC World Upgrade Anytime

Perhaps I am posting in the wrong place, not too sure. But here goes..
I went into Derby Kingsway Currys PC World branch in Feb 2016 with the intention of buying a laptop. The laptop recently went very wrong and I had to dig out out my receipt, etc as I have a Knowhow careplan with Currys. Then noticed it was a rental agreement rather than a credit agreement and have complained to Currys PC World recently about being mis-sold the agreement.
On that Feb 2016 day, it was a very busy weekend day and it took ages for someone to talk to me about laptops. Other Currys branches in Derby had recently closed so the Kingsway one was extra busy with not enough staff frankly.
I same to have ended up with a Upgrade Anytime contract which runs for 2 years which is a rental agreement. Having stated at the time to the store sales assistant that I want to BUY a laptop and am happy to spread the cost along with the careplan, virus protect and cloud storage, I was taken to another sales assistant who very quickly did the 'sale'. He explained that payments of X amount would be direct debited over 2 years and I was happy with that. I passed the credit check (unfortunately). He printed off the contract and I signed it. I know how store credit works, etc so I didn't read the contract agreement at the time. Wasn't really offered any time to read it anyway as the sales assistant was rushing as he had a queue of customers waiting.
As stated earlier I have recently complained to Currys PC World that the word's lease/hire/rental were never mentioned by the sales assistant. I made it clear on that day I wanted a credit agreement. The rental is through Rentsmart i know now who are a shady bunch of con-artists and there are numerous complaints about them all over the internet. This name was not mentioned verbally by the sales assistant ever, it's not on the name badge, the store is not called Rentsmart. This feels very much like deception to me. I said in my complaint letter I am not happy to pay extra money to Rentsmart after my 24 months in order to keep the laptop. I am 100% not going to return the laptop in order to take out another 2 yr agreement with them . I have never been entirely happy with the Lenovo G50-80 as it's always been very slow at doing anything and has already gone wrong once. All the response I got from Currys PC World to the complaint letter was that I should have read the contract at the time. I can take my complaint to the Ombudsman if I want to

+4 payments @ 24 payments to keepKeep the model you've leased – just make 4 further monthly payments and it's yours to keep, OR
Return the model you've leased – do so and you've nothing more to pay
£1000 purchase = £1162.72,plus a further £178.88 to keep.

So OP has to either pay £178.88 or return the laptop .0

It will be the financial ombudsman she's referring to I think given it sounds like a HP agreement.
OP, you seem to be confused somewhat. The agreement you have IS a credit agreement. Its incredibly rare for the retailer to be the creditor. Even for catalogue companies, you'll find the retailer is something like Shopping Direct Ltd while the finance provider is Shopping Direct Finance Ltd. You actually have less rights if the retailer provides the credit (section 75 doesn't apply if the retailer & creditor are the same).
As for not reading due to there being a queue, personally I would have told them to continue serving other people while I look over the agreement. But in any event, credit agreements are particularly lengthy & complex and as such, attract a 14 day cooling off period. The reason for this cooling off period is to give you time to look over the agreement and cancel if its not what you were expecting/wanted. And by law, that agreement would have had to have the lenders details, total amount borrowed, total interest, total repayable etc. The very reason for them having to provide that information by law is so consumers can make a clear informed choice and can't be misled.

Thank you for your replies. I have done some research on the information that should be written into the contract such as a description of the goods, total cash price of goods, total price of goods with interest, the APR should be stated also. Plus a note about Cooling Off period although not necessarily using the words ', cooling off'. These should all be on the contract so consumer has a clear idea of what they are signing up for.
None of that information is on the pre-contract or actual contract. I have monthly payments and number of them and that is it.
I have emailed the CAB for further clarification.0 -
You say its slow but what have you installed on it ?
So you bought a virus protect thing, iz that anti virus then ? Which anti virus is it if it is 1 ? Maybe this is causing it to be slow.
OP you need to learn that a credit agreement is in front of you you need to read it irrespective if theres a queue forming, as been mentioned you ask to read it while the other customers are served, at that point was the time to just walk out.
Hindsight is wonderful, you could have got a 0% credit card and bought from 1 of the many retailers selling laptops, Dell for one.0
