  • So you think the D actually made a SO/SJ application?
I've never seen a hearing listed Like this in the court list, and have made both types of applications in the past. The cases were just listed as X v Y in the normal way.

Ask them. They'll likely have the original listing.

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

26/10. Over one third of cases are set-asides. Scandalous.

    42/12

Starting the new month off with a bit of a bumper list - 42 cases. Of these there are 12 set-asides, so a dozen people who have likely had their credit rating trashed more often than not through no fault of their own.

I have been doing a bit of reading. Many on here say that you need a credible defence to get a set aside, but you can apparently get one if you think the amount of the debt has been incorrectly calculated, which almost all PPC CCJs have.

Also, what if you are not disputing the debt and would have paid a the lower rate if you had received it.
You never know how far you can go until you go too far.
