    It is not yours, so giving it away, throwing it away or even leaving it outside for them to resolve could lead to criminal charges,

    Civil Charges, not criminal.

    I have no intentions of giving it away or doing anything to it unless I know I can rightfully do so which was the point of thread to find out when/if I could give it away.

    I'm hanging fire on contacting the police at the moment as the tv is part of a crime but the company are the 'owner' and I am trying to return it to them. I have emailed them telling them I'm annoyed at the way we have been treated as we are a completely innocent party who have been dragged into this, they have until the end of the day to arrange collection or I am contacting the police and handing over the tv to them. We will see what comes of it but at least I have warned them.

    I have no intentions of giving it away or doing anything to it unless I know I can rightfully do so which was the point of thread to find out when/if I could give it away.

    To be fair, the retailer are an innocent party also. Its not as if they've knowingly contracted with a fraudster and the fraudster provided your details to them (meaning they already had them). If you don't already - shred everything with your name & address on. And again if you haven't already, check on experian to make sure there haven't been more accounts taken out in your name.

    Be aware though that you are under an obligation to take reasonable care of the goods and should not dispose of them until you have sent 2 written notices to the owner. I'd be wary giving them to anyone else, especially without allowing a reasonable deadline for them to arrange collection. We are literally only the 4th day (3rd working day) from when the tv was delivered. Nowhere near a reasonable time.

    True they are also an innocent party but all it takes is to keep me updated as to when they are collecting it, if they couldn't do Tues & Wed am this week why not let me know and we can re-arrange another time, I'm not obstructive but good customer service would keep me up to date and not waste my time. Three days is a lot of time when you have things to do plus the tv is 55"s not exactly small and easy to store away. Funny that they advertise next day delivery but can't pick up in one or two days.

    Yes but the delivery cost in the price of the item. as you are not a customer and not making a purchase they will just use a standard 3 to 5 day collection service and most of these you cannot give specific times

    True but why not arrange a time for later in the week or next week and keep me updated not have me sitting around waiting for a courier not to come, they are a very big company and could absorb the price of this collection due to the circumstances.

    Would this generally count as an unsolicited goods? In which case props to OP for being very honest and getting in touch with the company - it's my understanding you are well within your rights to keep unsolicited goods.

    No, it wouldn't be classed as unsolicited goods. Goods sent by mistake or ordered by someone else are not unsolicited.

    They've said they'll let you know when to expect the courier. You didn't need to wait in for them. Just make sure they have your mobile number and they can let you know when the pick up is booked.

    I've just heard back, they have accepted that I have recieved poor service and have escalated the matter. As suggested by IAmWales I have told them I am not waiting in but to give me some notice of when it will be and to leave a message on my answer machine. Here was me all ready to donate it to Victims Support for a raffle ;).
