Add in the bit about unreasonable costs
Refer to your letter of X responding to them as well, so there is a trail of all the times you contacted them.

Thank you again nosferatu1001, slightly confused about costs. I thought was just showing them as unreasonable litigants. Please could you explain how I can best put the correct points across in my reply? What does CPR27(14)(2)(g) costs relate to and support my claim for what?

    Court Procedure Rule(CPR) 27 (14)(2)(g) states:
"such further costs as the court may assess by the summary procedure and order to be paid by a party who has behaved unreasonably"

Basically means you can claim 'extra' costs not just expenses for the day (travel, parking and loss of earning up to £95) if you can prove the Claimant was 'unreasonable' assuming you win your case.

Yes, and it’s pretty clear, if you read the actual CPR referenced.

My draft response, anything else to add/remove? TIA
    Dear Mr Hawker,

Again there is concern that you are requesting details, given I have provided you with a full response to your letter of 11/10/2017 and reference number: 1572805.

It would appear you are still attempting to stall matters by asking such questions. If this process goes to court I shall use these correspondence as evidence of your unreasonable behaviour to support a claim for CPR27(14)(2)(g) costs.

I can see nothing in there asking why they won't answer your questions - as you suggested you were going to write in post #90.

Thank you, email response now sent.
  • There seems little point writing to them- other than to build evidence that you have. They don't read them. They will still continue to harrass by phone. In fact- I think I might change my number. They are driving me mad. I wish they would just issue proceedings.
    Chin up.

Can’t you just block their number? If it’s a landline, complain to your provider (BT?) that this is a persistent nuisance caller. AIUI big penalties can be imposed if you eventually escalate this via OFCOM.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

If its a mobile, just block it. Easily done. Save their no a sa contact
If they call, tell them firmly you do NOT wish to be called any further, that you are keeping a log of all such calls, and these will form the basis for complaints to OFCOM and the ICo, and leave them and their principa liable for a breach of the Protection from harassment Act (think thats the right one...google it)
