My partner visited Darlington yesterday. Purchased a parking ticket from the machine.
Came back to her vehicle and found this notice on the windscreen.

When logging onto the website, the photographic evidence, shows the ticket on the dashboard. Upside down. Perhaps flipped with the breeze/closing the door. Her fault which she accepts.

The website has 3 options.
Pay Now
Appeal the PCN
Enter Liable Party Details

My main question is, should I be using their portal to appeal directly now, with a photo of my valid ticket? Or is there a better way?

Wait for the Notice to Keeper to come to you within 14 days from Excel Parking (this is one of their windscreen tickets in reality), then appeal it using the IPC operator appeal template contained in the NEWBIES FAQ sticky, post #1. It will be rejected; further, you have no chance of a successful appeal at the IPC's second stage appeal with the IAS.

So - you're in for the long run on this. Ignore debt collector letters which will likely come your way in due course. Do not ignore court papers which may come your way. They have 6 years to pursue you.

You can possibly get it killed by complaining to the landowner - especially as you had paid (retain that ticket) - and asking them to intervene.

Same advice as you will find on every other thread with the same title as yours. All the same stuff, no need to repeat it time & again until court stage.

keep hold of the paid for ticket , as evidence if EXCEL or B W LEGAL try a court case within the next 6 years

a judge may well take the view that there was no intention of fraud and the parking was paid for , so no loss occurred

Not sure that helps with a very experienced regular who could really have assisted you with your problem. Sometimes things are overlooked in the volume we are dealing with. Just re-asking your question might have been a much better way of doing this.

Just putting a question mark at the end of a sentence doesn't necessarily turn that sentence into a question.

In fact, remove your question mark and you've actually got your answer.

Not by our reckoning.

Do please read the NEWBIES FAQ sticky, post #3, to read the cons and cons of appealing to the IAS, where they have promised their operators that 85% of motorists' appeals will be dismissed by them.

Unless you've got absolute and categoric proof (photo evidence, physical exhibits, witness statements) of any point you are appealing on, it's virtually guaranteed you will lose.

Losing on appeal firstly to the operator, then secondly to an 'independent specialist' parking adjudicator is not something you would want them waving in front of a judge!
