    Where in the Highway Code does it suggest that stopping to let someone out of a side road is a good idea?

    I blame the guy who stopped - if he hadn't stopped you would have waited until there was a gap in the traffic.

    As it is you moved out when the road was not clear.

    Or did you think that the car which you hit had a duty to stop behind the car which had stopped for no other reason than to let you out?

    But what if the person who let him out had stopped because there was a yellow box? The OP would have been within his rights to enter the box and wait until it was clear to turn right. The same accident could have happened. Whose fault would it have been then?

    What side of the road was the third party on when the collision happened?

    His side or had he crossed the lines to the other the other side to overtake the stationery car?

    If he was on the wrong side of the road at point of impact you might be able to argue 50/50. If he was on his side of the road I don't think you have a case.

    No, he wouldn't. The yellow box doesn't remove the need to give way to traffic on the main road.

    The OP drove into the side of a car which had priority, and subsequently failed to "give way"
    A yellow box junction doesn't give you anymore rights in this situation as the OP wasn't stopped when the accident happened.

    But if there was a yellow box and the OP made his way in to the box and then carried on going because there was a gap in the traffic from his left then the other driver could still have hit him if he had overtaken the car which had stopped just before the yellow box.

    How is this any different from what happened except for the yellow box?

    Surely the Highway Code encourages people to let cars out of side streets with yellow boxes.
