No need to answer on here but if you haven't been paying rent and there was no formal agreement for your living there (even if there is the wife would need to prove it) can you look at claiming squatters rights/adverse procession.
I am not sure what it is call but is there a way you can see if a solicitor will take this on with lower cost to yourselves as it is an usual situation and may lead to a 'test case'.0 -
The OP has mentioned the £40k spent on repairs several times but at no time has she mentioned rent. Though the sum spent on updating the property sounds large it would be a bargain compared to paying market rate rent for several decades. The OP should have sizeable savings by now if she and her family have been living cheaply for such a prolonged period.
Rent was paid as well. So I have no savings as rent plus all repairs and renovations have left us with nothing so you can't always presume0 -

I know everyone that knows the circumstances is quite shocked. His friends are really disgusted by what he's done and are all helping me , and they knew him well and have heard from my mum and dad over 60 years the promises and seen what we've done to the house and why we have .
We paid rent so no squatters rights either . In hindsight I would never have moved back and would have been pretty well off as the house I was going to buy before being pursuaded to move back has rocketed in price . I just hope my whole family doesn't have to pay for my mistake.
In hindsightI would encourage my mum to have put it in writing but she was a lovely person and very trusting . If I've learnt anything I'd tell people to never even trust your partner to uphold your wishes , no matter how much you believe they will . Get it in writing!

So why didn't she ask her father to transfer the property to her during his lifetime? This is a man who, according to the OP, had such control over her mother that he didn't allow her to write her own will and who remarried twice and went on to have a further child. Alarm bells should have been ringing a very long time ago.
You trust your father despite their flaws as I never believed he would do that and thought he was trustworthy as he confirmed this not just to me but many people over the years - even since writing the last will - ''this is from someone who doesn't know me but knew him.
I never believed he would hit my mother many times either but that's a new revelation that has come out from many people as well. Hindsight is great !0 -

Reading your posts again, you say that a previous will written AFTER he got with latest wife stated the house should be left to you but you've been informed a further will was drafted leaving you out of it. Do you know when that latest will was drafted? Could it be after he started to have issue with his memory?
What are you trying to accomplish? Evidence that you should be entitled, evidence that she shouldn't or both?0 -
Surely if anything, this will go against you. Why if he intended to give you the property would he expect rent from you when he didn't have a mortgage to pay. That means he treated you like a tenant, not a family member he wants to handover the property to.
It's ok, I've had a barrister go through my case and he obviously knows what he's on about and all the exact circumstances with all the evidence and he says I have a good case so I don't need advice on the case to be honest. I just needed this final piece of the jigsaw and thanks to the nice people on the thread I will be getting the answer in the next week or so.

I found out. I have the date so they are legally married , all it shows is that she got pregnant to ensure he had to marry her , which I knew anyway .
Apparently the private investigator said that is what they often do there to make sure they will get married.
I'll update with how the whole thing went in a long while when it's finished as it may help someone else one day.0
