  • Good luck. Let us know how you get on. This is a decent case based on confusing signage.

  • Indeed, good luck - and please let us know the outcome, either way
Try to get the judges name, as well as the firm and name of the advocate for the other side.
the more detial you can include, the more helpful it is for others.
  • bump to keep on front page.
Had my fingers crossed all day for a successful outcome. :)
  • Just getting chance to post. The judge dismissed the claim :)
I'll give a quick rundown for anyone worrying. It was not intimidating, especially as Gladstones didn't send a representative. It was just me and the Judge in the room (who was dressed in a suit and was very pleasant, I was worried I'd be so intimidated). He explained that as Gladstones were not attending he would read through their statement, which he did, sometimes pausing to ask me questions. Then he went over mine and the google earth image and photos. He asked if I had anything to add and I spoke about the conflict of interest with the IAS and Gladstones. Then he spent a few minutes writing notes and told me he has dismissed the claim and they could not prove that I was aware I was entering into a contract when driving in to their part of the car park and that their signage was insufficient (in fact he said he could not see any evidence of signs on the route I took).
Thank you all so much. I am so glad this is over but I will pop back on the board to offer advice to anyone who needs it. This forum has been so helpful.
Claxtome, I will PM you as this is great for your case.
    Thanks again everyone!

Yay, well done! Knew you could do this!

  • Fantastic news. Well done :T:j
Interested to know more details but no rush.
Could you provide case number and anything else that you think would be useful from your experience today for my very similar parking case.
Did you manage to claim costs?

Time to have plenty of
  • Will PM case number for you.
I didn't claim any costs, I know I should have but i'm up the wall at home, we should have moved today but it's next fri now and I've just got too much else on. I don't think you will have any problems recouping your costs though.
  • It was St Helens Court. Great news for the other poster too!
  • Winner, winner!

It was a good case on the facts. Not altogether surprised no one showed. A shame you weren't prompted by the judge on costs - a kindly DJ might have asked "how did you get here today?" So you got petrol/rail costs back.

Oh well. Nicely done. Glass of wine and back to domestic bliss

    well done from me too

I am amazed to read that you sent them a cheque for £60 , I assume they failed to cash it, then they lost in court and so lost their court fees etc too

greed and avarice cost them dearly !!!!
