NWCP Car Parks PCN - Over 28 days

I received a Windscreen ticket from NWCP car parks on 23rd Oct. I chose to ignore it at the time as thought nothing of it. Today I received a Notice to Keeper (dated 9th Dec). I believe you appeal on day 26 after receiving the windscreen PCN. I have read the letter and there is no mention of a windscreen ticket (dont think so anyway)

In the appeals section it says "In the event that you wish to dispute liability for this parking charge, within 21 days (beginning with the day after that on which this notice is given.

How do I proceed as you have to appeal within 28 days of the PCN ticket but as there is no mention of the ticket on the notice to keeper I presume I can still appeal as it says within 21 of this notice. Also mentions 28 days further down the paragraph.

Do I just go ahead and send the letter in the NEWBIES thread?

    Sounds like an IPC firm, allowing only 21 days. You can challenge straight away to a postal NTK, making sure the driver is NOT implied nor identified. Be aware this will not cancel the charge, and you can enjoy and look forward to stupid debt collector letters all next year.

    Yes it is an IPC firm. Will send off email to them. I await all debt collection letters ready for the bin.

    How many of these actually end up in court? As its an IAS company do I just do nothing after sending the letter and hope they don't send case to court?

    You can always find out court numbers by Google searching 'BMPA insight' and the name or acronym of the parking firm. Do that now.

    No link, I want other newbies reading this to see how easy it is to find the court claim numbers of any parking firm with one search.

    As per what I found

    The company joined the International Parking Community on 28/07/2016.

    Therefore fairly new to parking. Tickets issued Jan-Sept 2016 - Low or only manual requests. Court hearings 2016 - 0.

    I would say low chance for court but as they are new its hard to tell. Updated every 3 months and only been active for 4 months so unsure there has been any in those 4 months. Il keep checking

    Good point, I will do that.

    A new firm with no court experience is not going to suddenly start suing people. They wouldn't know how and if they use Gladstones solicitors, they will regret it if you look at the Parking Prankster's blogs about every time Gladstones have bungled a case! No doubt easy enough to defend if push came to shove later (within 6 years, to recover an alleged 'debt').

    I have now received claim form from County Court Business Centre.

    I have briefly looked at the newbies thread so aim to acknowledge the claim form online. Do I do this immediately?

    I have no idea on how to go about submitting a defence and what to write.

    The claimant on the form is the actual parking company - N W Car Parks LTD.

    I think you have 14 days to acknowledge the claim to gain the full 14 days before the next step.

    There is a link to a court guide by bargepole in the NEWBIES threas, and a whole court section in the NEWBIES as well.

    That will tell you what to do and when, and also how to fill in some of the proforma boxes.

    The two most important thaings to start with are, acknowledge the claim to say you are going to defend this, and, do not put anything in the defence box. Nothing, zilch, nada, not even a full stop otherwise it is assumed that that is your defence.

    Iv had a read and its says on there "show us your tailored draft defence". No idea where to start. Is there a template most use. If not and I have to do my own I don't have a clue what to write and how to go about writing it.

    Neither. Look in the NEWBIES thread post #2 for linked examples & info on defences and copy a similar one. If none is similar, search the forum for the word defence with the word 'permit' if it's about not displaying a permit, etc. DO NOT WRITE YOUR OWN FROM SCRATCH.

    Without telling us who was driving, in the third person(!) what were the circumstances?

    BTW I eat my words where I said:
