  • Just read the newbie thread. It says the following

    Once allocated to your local court, you will be given a clear date by which YOU MUST file the evidence ('exhibits') and any Witness Statement.

    As I have not been given a date by which I must file the evidence so I have not filed any evidence. I have also not submitted a witness statement as no date.

    Should i have received a letter asking me to do any of this. What happens now as court date only 10 days away.

    Phone the court and ask their advice. They're usually helpful.

    It's usually on page two of the letter that gave you the court date, saying about the parties having to exchange their evidence. But if confused, phone and ask, don't let it slip.

  • You WILL have been told when to exchange documents, its on the courts templates. Usually about page 2, para 6 or so, they talk about exchanging docuyments

    You MUST write a WS and include in it references to any photos, letters etc you want. This is URGENT that you get this done.

    Iv looked at the letter I received with the court date. I have found where it mentions when I have to submit a witness statement. It was on page 1 and I completely missed reading that part. I received 2 pages. Page 1 as per link below and page 2 which had the court date and the info about the claimant having to pay court fees. As page 1 started off with mediation I ignored reading the paragraph below that thinking it was all about mediation. Very big mistake on my part. Would've thought this would've been on page 2 but was on page 1.
    I have missed the date as it was suppose to be submitted by 15th September.

    Is the page below how it is usually?

    Stuck now and unsure what to do. Will the court accept my witness statement if I submit now. I haven't even started so will be at least another few days. Can phone the court and see what they say.
    Could ask to extend the court date so I have time to submit evidence as court date is 29th Sept.

    On my directions questionnaire I did put if possible not Friday. 29th is Friday so unsure if I can mention this or not.

    Advise please

    It's only the Court who can help you with this now. You need to get on with contacting them.

    I've completely messed this up haven't I. I thought I would get another letter confirming payment made and hearing will definitely take place. As I hadn't heard back I then wrote on this forum. A misunderstanding on my part.

    Hopefully they can agree to re-schedule hearing so I get another date for witness statement submission date as highly doubt I can do a Witness Statement so soon. Panic time. Will ring court tomorrow morning.

    No, do what everyone else does who makes this common mistake (and still wins in court). It's Thursday, get a WS in by Friday morning. NOW.

    We've even rescued people who had 48 hours to go before a hearing, and shoved in a WS (and won).
    Hopefully they can agree to re-schedule hearing

    Do a WS, they are not difficult, an attach your evidence, yes you can do this and could have done it tonight instead of posting/dithering, assuming you've wrecked it. You have not, get on with a simple WS just like the ones in the NEWBIES thread - easy stage. Don't apologise for lateness, just file it!

    It goes to the court with your evidence (photos, case law, etc, just like you see in the examples) and a copy to the other side which can be by email but must be a full set.

    Don't spend too long on it, it's a statement of the facts and the evidence you already have in mind.

    Thanks for the response and reassurance that I can still submit a Witness Statement at this late stage. I have been reading several but at this moment in time I do not know where to start. By the time you read I may have made a start. Issue is as I only have a day I cannot get opinions from people.

    A question about Witness Statement. Does the WS need to be titled witness statement. I received a defence from the parking back in June. When we received a court date the claimant sent another copy of this again dated 1st Sept including photos of car, contract, debt collection letters sent to me, emails I sent and land registry registry document. Can they use this as their WS. Presume they are using this as their witness statement but not titled WS.
