Current running total of number of cases in court is 3(BMPA Insight). Was 0 earlier in the year so they do take to court now.

These are all small claims court cases, not necessarily Parking related, the figures will also include when they are the defendant.

AFAIAA, the numbers include default judgments where court papers have been served (possibly to a former address) and not acknowledged/defended, with a default judgment following.

Numbers too small to read too much into them.

You have to separate out the "who" from the "why". This is Gladstones sucking up cases from parking companies with their no-win/no-fee promise or £25 to send out a few letters. 99 times out of a hundred there is no intent for it to go to court and if it does, it's because the defendant has sent in a !!!! poor defence or more likely an admission of guilt.

These companies are commercial and only do it if they know they won't lose money. Look at the number of discontinuances.

But surely the first sentence said 'I am xxxxx xxxx and I work for NWCP...' ?

I read all five pages and no names are given anywhere; just a signature, (but no name on the final page).

According to the "witness" in section 4.1; the car park is called Sykes Street:-

Problem is there's no Sykes Street in Preston, only Syke Street and it different to Church Street.

I was present at NW's first attempt at court in Liverpool. They did not submit a witness statement but provided a timeline of events almost identical to the ones above. The DJ questioned their employee (who is allegedly a Business Development Manager) as to why NW did not submit a witness statement. Her laughable response was that they did not know they had to provide one (it was the defendant's first county court appearance too and they managed to fully comply with the court's directions!) The DJ dismissed the claim for NW's failure to provide a ws and for the fact that one wheel was just over the white line.

Syke Street is a pay and display car park and obviously an entirely different car park from Church Street.

There is a car park off church st where the car park is based. Its on Guild Row Church St Preston so not sure where Sykes Street comes from. Its next to Ace Ringway Taxis. The parking enforcement contract also states Guild Row so this is definitely a mistake on their part.

Just read that Elysander case had Sykes Street so I reckon they have got confused and inserted the same street name as Elysander into my case papers. Will also mention this on the day.

I read about your case as coupon-mad posted it in my thread. Did you receive the paperwork/timeline of events like the one I received after you received the court date or when when the defence was due or both times?

Not sure how I can use your case in front of judge and saying NW Car Parks did not submit a WS in your case and the judge dismissed the case on this basis. NW car parks have made a similar mistake again as can argue their alleged WS is not a WS as not titled a WS.

It wasn't my case- I was just an observer.
