    they will have paid the initial costs but not the second part

    this is small claims and the max costs are £50 for a solisitor , you have not been found guilty do the £60 -£100 does not apply

    May as well write politely to the Judge (as planned above, pointing some omissions out) and also attach a copy of your costs schedule, in case the Claimant doesn't pay the fee. And ask for clarification: if the Claimant does pay the court fee, when will you get the chance to amend your defence and by what date, as stated in the previous strike out order.

  • I have written a letter. No response yet. The second court letter I received as I mentioned above which said they need to pay court fees which also had a court date of 29th Sept. I have had no other communication from the court to confirm date and have no confirmation weather they have paid the court fees or not. I did receive another copy of statement of truth therefore presume they have paid but can't say for sure.

    My question is will my hearing take place 29th Sept? Should I have received another letter from court with the date again confirming hearing? Don't know where I stand at present. If I have to attend court when I do I submit skeleton argument.

    Yes, unless the other side discontinue.

    You got your Witness statement and evidence filed a while back did you, we can't recall?

    Skeleton argument is up to you, they are not mandatory and just ct as a crib sheet for your defence points. You do need to send all parties your costs schedule, as per the NEWBIES thread example.

  • I submitted my defence when it was due. I have no witness.

    I have not been asked to submit any evidence. Only 2 letters from the court. Both addressed to claimant which I mentioned above. I have not been asked to do or submit anything else. First letter even said I will be given a chance to send an amended defense. No letter to ask me to send amended defence.
