Parking Charge Notice from Euro Car Parks
Comments
-
Only the registered keeper should contact them, so your friend should email it from their own account
Is the letter a 'notice to keeper' or a letter referring to an NTK that they say has previously been sent?
Does the car park have ANPR cameras or an attendant putting tickets on cars. If it's the former and the letter received on 10/4 is an NTK then it is out of time and not PoFA compliant. If it's the latter then they've sent the NTK in time
Upload it to dropbox or one drive and post the link, changing the prefix from http to hxxp. Someone will then activate the link for you
Has your friend communicated with them at all? If so what have they said? they MUST NOT say or even suggest who was driving - refere only to "the driver"
I am the registered keeper.
The letter is a 'notice to keeper' - it is the first time I have received anything, there were no previous letters or anything stuck to the windscreen of the car.
I think there are ANPR cameras, as it was very, very late at night and chances of an attendant putting tickets on at that hour are unlikely. So, if it is out of time and not a PoFA complaint, then what should I do now?
I have attached the image link to this post.
There has been no communication with them at all.
Thanks again for all your help Lamilad.

I should also mention, that I haven't yet sent the appeal letter, as you said the letter received on 10/4 is an NTK then it is out of time and not PoFA compliant.0

Just submit the usual appeal like everyone does here, to get a POPLA code. Not by post/letter though!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi Coupon-Mad,
Would I still email an appeal, from my personal email address, if there are ANPR Cameras, this letter was the first correspondence I have had from them and:
Date of Issue: 12.03.2017
Date on Letter: 10.04.2017
Date Received at Home: 18.04.20170 -
Yes, appeal anyway as it is the first letter.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thank you Coupon-Mad. Should I appeal via my personal email address, (I am the registered keeper of the vehicle and the one who received the letter). Should I use this template:
Dear Sirs
Re: PCN No. ....................
I challenge this 'PCN' as keeper of the car.
I believe that your signs fail the test of 'large lettering' and prominence, as established in ParkingEye Ltd v Beavis. Your unremarkable and obscure signs were not seen by the driver, are in very small print and the terms are not readable to drivers.
There will be no admissions as to who was driving and no assumptions can be drawn. You must either rely on the POFA 2012 and offer me a POPLA code, or cancel the charge.
Should you obtain the registered keeper's data from the DVLA without reasonable cause, please take this as formal notice that I reserve the right to sue your company and the landowner/principal, for a sum not less than £250 for any Data Protection Act breach. Your aggressive business practice and unwarranted threat of court for the ordinary matter of a driver using my car without causing any obstruction nor offence, has caused significant distress to me.
I do not give you consent to process data relating to me or this vehicle. I deny liability for any sum at all and you must consider this letter a Section 10 Notice under the DPA. You are required to respond within 21 days. I have kept proof of submission of this appeal and look forward to your reply.
Yours faithfully,

Thank you so much Lamilad and Coupon-Mad for all your help and advise.
I have emailed them from my personal account this morning, so fingers crossed this is the end of it now!0 -
I have received the below email from them, what should I do:
Good Morning
If you wish to appeal please follow the appeals procedure
The appeals procedure can take up to 35 days to process your appeal
Signage on site is quite clear in its intent
It is the drivers responsibility to check all signage
You appeal has to be processed and rejected before a unique POPLA Code can be issued
Since the amendment to the Protection of Freedom Act October 2012 – all private car park operators have registered keeper liability
I am unable to assist you further
