Parking Charge Notice from Euro Car Parks

Hello All,
Looking for some advise as I have just received a Parking Charge Notice from Euro Car Parks, which is the car park for Sainsbury's, Stanmore. I did not receive a ticket on the car on the date in question and this is the first time I have received anything from them.
I couldn't shop there that night, as it was closed and the payment machine was not working either, plus there was a few cars already parked there, so I left their car there for a few hours. We have all parked there before, after hours, as has been previously allowed. There was also no visible signs to say this was not allowed.
Do I have to pay it or can I just ignore it, as this parking ticket, as in a nutshell private charge notices are not able to be enforced - would that be correct?
TIA.

Have you seen that there's a "NEWBIES" sticky thread at the top of page 1 ?
This tells you what to do. It even gives you an appeal letter to send in post #3.
Once you've read all that type 'Euro car park' into the search box atop page 1 and read lots of other cases just like yours (last 6 months only).
If you still have queries after that come back and update your thread0 -
Hi Lamilad,
Thank you for your reply.
I did have a look, but was very confused as to which template I should use, to appeal. Apologies, but this is the first time I have been in this situation and appreciate any help you can all offer.
Sorry for being a pain!0 -
Would this be the correct template:
Dear Sirs
Re: PCN No. ....................
I challenge this 'PCN' as keeper of the car.
I believe that your signs fail the test of 'large lettering' and prominence, as established in ParkingEye Ltd v Beavis. Your unremarkable and obscure signs were not seen by the driver, are in very small print and the terms are not readable to drivers.
There will be no admissions as to who was driving and no assumptions can be drawn. You must either rely on the POFA 2012 and offer me a POPLA code, or cancel the charge.
Should you obtain the registered keeper's data from the DVLA without reasonable cause, please take this as formal notice that I reserve the right to sue your company and the landowner/principal, for a sum not less than £250 for any Data Protection Act breach. Your aggressive business practice and unwarranted threat of court for the ordinary matter of a driver using my car without causing any obstruction nor offence, has caused significant distress to me.
I do not give you consent to process data relating to me or this vehicle. I deny liability for any sum at all and you must consider this letter a Section 10 Notice under the DPA. You are required to respond within 21 days. I have kept proof of submission of this appeal and look forward to your reply.
Yours faithfully,0 -
That's the one. It will almost certainly be rejected but then they give you a popla code and that's where you should beat them. They couldn't shop there that night, as it was closed
Was it dark and were the signs illuminated?0 -
Hi Lamilad,
Thank you for your reply.
Super - should I do this via an email from my personal account or post it in?
The car park lit well, but the payment machine was not working. Also no ticket was left on the car, just a letter come through which said "The driver has failed to pay the notice amount within the time specified." Yet this was the first letter from them demanding the £70!!
Do I just add in the PCN number and sign the letter of with my full name and send it?
Thanks for all your help.0 -
PS. Thought it may be worth mentioning:
Date of Issue: 12.03.2017
Date on Letter: 10.04.2017
Date Received at Home: 18.04.2017
Does this make any difference? I would post a copy of the letter on here, but I can't seem to do it?0 -
Only the registered keeper should contact them, so your friend should email it from their own accountSuper - should I do this via an email from my personal account or post it in?
Is the letter a 'notice to keeper' or a letter referring to an NTK that they say has previously been sent?Date of Issue: 12.03.2017
Date on Letter: 10.04.2017
Does the car park have ANPR cameras or an attendant putting tickets on cars. If it's the former and the letter received on 10/4 is an NTK then it is out of time and not PoFA compliant. If it's the latter then they've sent the NTK in time
Upload it to dropbox or one drive and post the link, changing the prefix from http to hxxp. Someone will then activate the link for youDoes this make any difference? I would post a copy of the letter on here, but I can't seem to do it?
Has your friend communicated with them at all? If so what have they said? they MUST NOT say or even suggest who was driving - refere only to "the driver"0 -
I am the registered keeper.
The letter is a 'notice to keeper' - it is the first time I have received anything, there were no previous letters or anything stuck to the windscreen of the car.
I think there are ANPR cameras, as it was very, very late at night and chances of an attendant putting tickets on at that hour are unlikely. So, if it is out of time and not a PoFA complaint, then what should I do now?
I don't have a dropbox and not sure how they work - could I please email it to you?
There has been no communication with them at all.
Thanks again for all your help Lamilad.0 -
if its a redacted photo or scan , host it on a hosting site like tinypic or photobucket and then add the URL link to your reply, changing the link from http to hxxp
one of the regulars will then fix the link in their reply0 -
