Because the EA relayed what the vendor wanted - BUT the vendor has no choice but to comply with what the law says. End of....
But this is a salutary tale that one should take the traditional 4 weeks between Exchange and Completion and then no-one has any excuse for misbehaving (be it vendor, buyer, removal company, whoever). With my 4 weeks I took on buying this house = 99% of my stuff was out of last house into removal van waiting to drive to Wales the day before Completion and I was staying in a friends house overnight and just going back for a 10 minute visit the following day to take literally a car full of last-minute-bits with me about 3/4 hours before Completion Time. Job Done.
So I think there may be an element of responsibility for this mess resting with OP - as maybe they pushed for too short a period between Exchange Day and Completion Day.
Being absolutely dead reasonable/practical/etc/etc oneself puts one bang on the Moral High Ground - and with 101% percent ability to insist all is "as it should be" by other "parties" involved.0 -

So the vendor did plan in advance that she was going to move over the long weekend. She even told the estate agent that this is what she was going to do. She even planned the completion date so that she could do this. With hindsight the leaving a few boxes in the house is the evidence that she was planning on using the weekend to move knowing that she would complete on the Thursday and not making the effort to be out on that day because she wanted to move over the weekend.
Now knowing that she planned not to move out on completion day perhaps the buyer would like to charge her storage fees for what she has left in his house.0 -
Looking at the other thread, OP should have told the solicitor and made the completion Tues.0

What is it about "LEGALLY BINDING CONTRACT" and "COMPLETION" and "VACANT POSSESSION ON COMPLETION" that some people don't seem to understand (or perhaps choose not to understand)? It's not rocket science, and if they don't understand the requirements then they should ask their solicitor to explain in words of one syllable. How arrogant to assume they can pack and move out on their own particular timescale because that's what suits them, and to hell with what the buyer is expecting. OK, so the buyer here has got off relatively lightly with no real harm done, and is able to be relaxed about it. But as someone said above, the family with a removal truck outside, nowhere else to go and two screaming kiddies on the drive wouldn't take the same view. What then? Sellers who do this are being incredibly selfish (and especially when the new property is three doors away!)0

I would have immediately changed the locks (which you should do upon moving into a new house anyway, and takes seconds for Euro profile locks) and told her to go away. If she wants her stuff, she can liaise with my solicitor who will be sending her a bill for storage of her items etc.
If she gets nasty, I would call the police, as this person is attempting to gain entry to my home.0 -
Why poor vendor? this shows is that she clearly knew she had to be out at completion and had a week to get her act together! Poor buyer if you ask me!
That's not being harsh, she knew when she had to be out and didn't get it sorted. I had less than 48hrs between exchange and completion when I last moved, had removal guys at the ready, had the house packed, emptied and cleaned in 36 hrs. It can be done if you apply yourself properly. Would have loved the luxury of a week!

I have read it! OP was asking for advice, which he got.It says about "a few boxes", doesn't say he agreed to the house being a tip and the vendors bed not being removed until today!0

I would just like to say that this lady is not a nice person. She is a con artist. She appears to come over as nice but that is only so that she can manipulate people to get her own way. A genuinely nice lady would not have decided in advance that she would complete on the sale of her house on Thursday and then tell the estate agent that she might not have time to move out and might need to leave a few boxes behind while all the time planning to use the days after completion to do the moving. A nice lady would have booked a removal company to move everything on the day.
I understand that this lady is going to be a neighbour so the OP needs to be careful and understand that this person manipulates others for their own advantage whilst using an excuse of autism to get away with it. She has probably been using this method to get what she wants for years. She also didn't completely tell the truth about the move because she had already told the estate agent that she might need to leave a few boxes so not only does she manipulate but she also tells lies.
I personally think that the OP would be doing all the neighbours a favour by talking to their solicitor on Tuesday about the breach of contract where they didn't get vacant possession on completion. This lady needs to be given a wake up call about her behaviour towards others.0 -
There may be some truth in cakeguts' post....OP says that vendor "thought she had until Friday" to get out and in the next sentence, states that she wouldn't be finished until Saturday!
Selling a house is not an overnight job, vendor would have had the offer and indicated her acceptance, then solicitors and EA hurrying her along. She then agreed a completion date...I daresay this has taken anywhere between 6-12 weeks at least. Plenty of time to get packed up and ready to move.
As for keeping a key? I don't think so! It's not her house, it's not even her home any longer. She's getting free bed and board and free storage for her crap, why should she get to come and go as she pleases? I would tend to agree with Cakeguts - there are Jekyll and Hyde type people around and she may well be one of them.
I can certainly think of a person that tends to be described as "lovely" - but I've seen the other side to them and know the "shadow" is distinctly vicious and nasty. However, they put on the "nice face" to those who don't cross their path and are obviously pretty convincing to them.:cool:0
