Ridiculous comment. We don't have a choice about exhaust fumes if we live in the city. That doesn't mean that someone should be subjected to a neighbors cigarette smoke, in the privacy of their own home. Obviously.0 -
You may be one of the rare exceptions but as someone who owns a flat and has had 4 consecutive smoking polluters put below our flat and not one of them has done anything to keep their cancer smoke from entering our home, you'd have a hard time trying to convince me that smokers are not inherently selfish people. Also, equating smokers with religious groups is ridiculous and probably offensive to those religions. Smoking isn't a religion, you can decide to stop the same way I can stop drinking. Smoking is a habit that has a nasty habit of affecting other people's air-space whether the smoker wants to or not! smoke travels, it is a gas and it gets in and permeates in places where you wouldn't think it could. The effects of second and third hand smoke are well documented and by invading other people's air-space you are literally creating the possibility of cancer for them. If smokers want to give themselves and their ''loved ones'' cancer then that is their business but they SHOULD NOT invade our choice of clean air. I have literally had enough of these inconsiderate smokers trying to give my children cancer. Also, to the OP there is a thing called statutory nuisance you can read about it. I'm seriously thinking about it myself as I don't want my kids breathing in somebody else's cancer sticks anymore when we choose not to smoke.

Did you read the thread and see the suggestions?
If not, allow me to summarise in 4 points:
1. block all holes and seal all gaps with things like sealant and mastic.
2. smokers are selfish.
3. smokers are not selfish.
4. car drivers are also bad.
Which all means that as somebody who cycles and doesn't smoke, I'm entitled to feel like a smug t###

Welcome to MSE.
As a tenant you do not have the right to attempt DIY on the flat and try to stop up any gaps. Check your smoke alarms and change the batteries if necessary.
Write to your landlord/ letting agent/ the building manager alerting them to this issue, reporting that gases are being transmitted between the different properties. Send the letters Signed For and keep the receipt.
This is a clear fire risk and needs professionally investigating and fixing to meet current Building Regs/ Fire Regs. They may ignore your report, or it may take a while to get actioned. I would suggest you move for safety's sake.
If you are in a fixed term contract so cannot move and no action is taken, copy your original letter to the local fire service and ask them to pay a visit.

Dodge it, bodge it and scarper are not renowned for their lifesaving skills.
The problem is twofold, the issue is with two flats. Issue needs addressing by both long leaseholders (and/ or the freeholder/ management company/ managing agent) to Building Regs/ Fire Regs.2. smokers are selfish.
3. smokers are not selfish.
4. car drivers are also bad.
Which all means that as somebody who cycles and doesn't smoke, I'm entitled to feel like a smug t###
