Of course it does. Not everybody bothers to go the appeal route after receiving a poor decision. I for one didn't bother when I had my PIP decision earlier this year. I just didn't see the point of trying to 'push water uphill'.
It would be interesting to know what the percentage is of poor/bad decisions being taken to appeal.
The percentage of passing is quoted quite regularly - approx. 60% of appeals succeed. That leaves approx.40% of those that appeal losing at a Tribunal.
If it was the other way round, I doubt as many would bother to appeal.0 -

By the way billy, how did your AA assessment go? I cannot be the only one who would like to know.
Is the fictitious PIP assessment above actually how your AA assessment went? After all if someone had a PIP assessment 'last week' they have certainly got the result very quickly as it normally has to go to the DWP to be seen by a Decision maker...
whereas maybe at an AA assessment you are told straight away?

We got there at 9.30am and the traffic on the M25 wasn't bad at all.
The assessment lasted all of 30mins. The questions to be honest were simply a re-hash of what I put on the claim form. She asked my wife how many minutes/hours did she look after me both in the day and night giving examples of the type of care given. She asked about adaptions etc.
That was it. We then set off back and had lunch at the services in Thurrock.
Just a waiting game now. Not really interested if I get it or not although it would be great if I did as it would prove that the DWP accept that I do have a lot of limitations and get help from my wife.
I had my PIP decision weeks ago as you well know.
I have no idea how long it will take for the DWP to decide on my AA claim.
Why are you interested in my old PIP claim? That is dead and buried as far as I am concerned.0 -

When so much about the report is baseless I'd say you should go on the attack in reconsideration and at tribunal if necessary in taking it apart in order to discredit any validity of it... of course while not being distracted from making argument for the descriptors which do apply. But we know from ESA that on occasions DWP DMs will cast aside a report as junk and that tribunals certainly may.. especially if presented with a credible alternative which is the claimant themselves in the flesh able to directly contradict such a report. In the end the evidence should be king... the DWP just unfortunately seem to place still far too much emphasis on these assessment reports out of convenience for them. More important is the fact that with a report like that you really don't have a chance in disputing it. That is unless you are wheel chair bound and/or have no legs.
Even if an award is made is there any system that would kick in for the DWP to investigate how a report of that nature was issued in the first place?
I would also be inclined to make relevant formal complaints including to the HCP's regulatory body. They at very least have lied, deceived and failed to follow protocol... and all of that could be considered very much not in the interest of the 'patient'.
