    In creditor-speak, is an 'assigned' debt a 'sold on' one please?

    Hi cbc,

    I am guessing so may be wrong but would have thought assigned was managing the debt rather than sold... one of the clever one's will be along shortly to confirm either way I'm sure..!

    Happy BH Weekend...

    Had a bit of a giggle at the expense of ca*ot this morning..

    Yesterday I received a letter from them saying we have bought your debt and told you about it in March yet you are still paying Halif*x blah blah... and then last night they rang me.. right stroppy madam when i said i couldn't talk then but would call them when I was free....

    So I rang this morning and advised them that they have actually written to me 3 times.. In march.. In bold letters it stated you do not have to do anything.. In april an apology for sending the wrong account details? didn't really understand that one and then the letter yesterday... The chap I spoke to was equally miffed, I also got them to remove my numbers and did advise that if they actually want to receive my huge £5 payment each month they should have requested it and sent payment details.. numpties...

    All well with my SM dmp.. just ticking along...

    Hi Carboot and all :hello:

    Quick update. I got a letter from Robinson's today...finally. They said that they've put my account on hold whilst their client tries to locate the CCA paperwork but then went onto say they are fine with me paying £1 per month until August and then increase to the usual amount in Sept. I wrote back to them and included my new I&E which shows a lower monthly amount now and said that I wouldn't be paying anything until they come up with the CCA agreement :rotfl:
    Let's see what comes of that!

    I'm still waiting for Robinsons to contact me (apart from their speedy acknowledgement of my CCA request and telling me they are working on it and will be in touch again in due course;))

    I'm finding that my self-managed DMP is actually fun:rotfl:

    So I'm still absolutely rubbish at this kind of stuff, but this thread has mostly been a bit of a godsend, but I've received this letter this morning

    Is it normal and just part of the next step in the dance? I honestly don't really fancy having Bailiffs turning up, or being issued with a CCJ since I can't pay them anymore than they're already getting now.

    Once again, thank you for any help that is given.

    Essentially yes, Banks often sell and buy debts from each other. An “assignment” is the name of the document that is the legal record of this transfer from one owner to another.

    So the new owner has all the rights and privileges that the previous owner had.

    "Despite several reminders including the issue of a default notice served pursuant to section 87(1) of the consumer credit act 1984, your account is still in arrears. This is a formal demand for you to repay the account balance above.
    If Payment isn’t made within 14 days from the receipt of this letter, we may instruct a debt collection agency to recover the debt and/or take legal proceedings against you.”

    Note the phrase "we may instruct", thats the crucial tiny little sign that its all bluff, it says we may, not we will, big difference.

    Thats just a standard "payuporelse" threatogram and is normally a sign they intend to close your account and sell it on.

    I assume they are aware of your DMP but they are legally obliged to send you these notices before a debt can be sold on.

    They will not take legal action, it will be sold to a specialist debt purchaser, there will not be any bailiffs at your door, dont panic, it is, as you say, just another step in the dance.

    If you want conformation from the horses mouth, just ring the creditor and ask them, they will tell you the very same thing.
