Just a quick update. So far I've informed all our creditors we are going self managed and requested CCA's from them. We have 6, all but one (PRA) have cashed the cheque . PRA said they will send the request as a gesture of goodwill and returned the cheque.
It's just over 2 weeks since we sent the requests. Some have acknowledged and others haven't......
No one has actually sent the copies of the agreements. I guess we just have to wait. I've no intention of making any payments until they comply.
Is there a standard time before they respond? I know they are supposed to act within 12 days but this doesn't seem to be the case.
Hi, Julie
I'm in the same boat as you waiting for the paperwork from my CCA requests. Out of my 5 requests, 3 have acknowledged they received my request and will be in touch 'in due course';). It is now day 35 since my initial request and I've still heard nothing:(. One creditor returned my PO and told me to contact the original debt holder directly which I have done. Early days for that one, they'll only have received it last week. One creditor didn't even acknowledge receipt of the original request and as I sent a PO rather than a cheque I don't even know if they received and cashed it. Will be sending a duplicate request to them tomorrow (minus the PO;))
To answer your question, I don't think there's a standard time before they respond. I took the 12 days mentioned on the template letter with a massive pinch of salt;)
Good Luck:beer:0 -
Hi all
Quick update from me. DMP plodding along nicely with Stepchange but I never told them about a Cap One Credit Card as I was going on holiday and needed a card for a swipe for car hire (nothing was ever taken but Alamo said they needed a credit card) the holiday was paid before the DMP so I thought why not go.
Anyway following the great advice on here I decided to self manage the Cap One debt whilst my DMP with stepchange plods along (I was scared of rocking the boat with SC to be honest).
I used the standard NEDCAB letter telling them I was in financial difficulty with a slight amendment and they have now written back (only took them six weeks lol).
They are asking for the I&E form which I am completing but they want bank statement and proof I am in difficulty....yeah right...they are getting the I&E form and a letter using the NEDCAB website and thats their lot. I am going to ask their bank details so I can set up a standing order, is that the right thing to do.
I was thinking of £1 payments for six months to get them to default quicker. What will they do if I send the I&E form but do not make any payments, will they default quicker or what else can they do ? They I&E form shows I can make higher payments and I am worried they will reject the token payments once they read the I&E.....help:eek::eek:0 -
Hi all,
I have a quick question about my defaults, which I probably already know what to do but I just recently checked my default dates since being on a DMP on Noddle and realised some of them have been defaulted really late.
I went on my DMP with Stepchange on Oct 2014 and below are the dates when my accounts were defaulted:
PRA (Old Barcs account) - Sep 2015
PRA (Old Barcs Egg account) - Sep 2015
PRA (Old MBNA) - Sep 2016
HSBC Credit card - Apr 2015
HSBC Current Account - May 2015
Santander current account - May 2015
Post Office credit card - Jan 2015 (I'm not too worried about this one probably)
What I wanted to know was that I have read here I can write to them to see if they will move my default date earlier to the rest of my creditors and if so I know there was a standard letter someone posted last week for this or week before but I cant find it, can anybody help me with that.
Also I am now on a self managed DMP so with my PRA ones above and HSBC one I could CCA these could I? and if so could I send this latter with the letter above or separately?
Thanks for reading.0 -
Hi all
I have just received CCA paperwork from one of our BCs. To be honest I don't even know what I'm looking for
It says it's a "reconstituted copy of your credit agreement, a copy of the terms of the agreement as varied in accordance with section 82 (1) of the act has been ( or will be shortly) sent under a separate cover.
Enclosed:
short form cancellation
Historic terms and conditions
Varied terms and conditions
To say I'm confused is an understatement. Can anyone shed any light please

Well done on at least getting something back from your requests:T even though you aren't sure what it all means.
I can't help, I'm afraid. as I'm still waiting for mine and am likely to be just as confused as you are:o. That's unless the creditor actually tells me that the debts are unenforceable, which I know has happened to some people on here. I'm living in hope of that happening to me:j
I think January is the person to answer your query. She hasn't been on here much lately, I hope she's alright.0 -

Afternoon all,
I've also received the first proper response back to my CCA requests apart from the initial acknowledgement. Think this is a good result as PRA (barclaycard CC) have said
we currently deem your debt unenforceable it goes on to say they can't take us to court to recover but that the debt is not written off and they will still contact us for repayment. So I guess this is the stage when I can offer F&F settlement. I can't remember if anyone has had success offering PRA 10%.
In the meantime do I pay £1 token payments or pay nothing until we agree a settlement.
It's all so confusing...Started Self Managed DMP 10th May 2017.

Just sent you a PM. But just to add, I'm not paying them anything. Not until they can stomp up the paperwork.
Come back January! We miss you0 -
How old do cc' s tend to be where paperwork isn't available, or does it just vary from lender to lender?Don't put menthol vape juice in your eyes!!!0

It's an unenforceable debt, you don't have to pay anything, what are they going to do ???I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards.
