  • I’m currently 4 months in to a dmp with StepChange, two creditors, Barclaycard and HSBC total debt £20k, roughly £10k with each. Barclaycard seem to have agreed but HSBC haven’t and have just issued me with a default notice. I know this is a good thing with a dmp but my question is regarding my mortgage. Are they going to try and take me to court to get this money because I have equity in my house? I have 30k equity but it’s a shared mortgage with my partner. I really don’t want to be taken to court or put my house at risk just when I felt this dmp had lifted my worries! Any advice or peoples experiences? Thanks

    Short answer is no, although the mechanism exists, its rarely used, in reality it does not happen.

    Long process before that would be a problem for you anyway.

    As long as you are paying nothing will happen.

    I can second the response given to you by Sourcrates :j

    I owed £95k (now down in the low £40k's :j:j ) and I have over £250k equity in my home. Even though I am paying token payments on my DMP, it has never been mentioned about using equity in my home, or putting a charging order on my home.

    The main thing is to ensure you maintain contact with your creditors (recommended that this is always done in writing) and that you come to an agreement with them on how much you are able to pay.

    I received my pack from Stepchange this morning and am all set to send them my account numbers payslip and Direct Debit mandate. I know the good folks on here recommend token payments for 3 months to build up emergency funds. How do you instruct Stepchange to start it in 3 months? Do I not send the paperwork back to them for a couple of months or do I send it and ask them not to start it until a specified date - say the 1st of December? I really want to just get everything sent off to them for startup but not if it means making my first payment next month.


    All advice greatly appreciated.
  • Hello, I'm looking for some advice please. I have just started a dmp with stepchange , and have received a horrible phone call from one of my creditors, everyday loans. They firstly questioned why I have not included the child maintenance with stepchange, I told them that stepchange had advised not to, as it's not court approves and not guaranteed. I have however included child benefit with stepchange, which I did not include with everyday loans. They then went on to say that I failed to tell them about all of my credit , I'm sure I did but they are adamant that I didn't and accused me of committing fraud. I am now terrified that they are going to try and prosecute me for fraud . Please could anyone give me any advice on this , i am so worried right now that they are going to try and prosecute me and I would lose my job.

    I'm so sorry that you're having such a traumatic time with Everyday Loans. What they're doing is really not on. I'm sorry I have no experience of your situation and can't offer any advice except to ask if you've contacted Stepchange since the phone harassment from your creditor.


    If I were you I'd phone Stepchange and have a chat with them about it. They may be able to offer you some reassuring advice.

They advised me to ask them to remove my phone number from their database if they phone again and to have all correspondence in writing. Unfortunately this doesn't stop me worrying .

    When you ask Everyday Loans to remove your number from their database, you should make that request in writing via the postal system. In the letter, confirm that you only consent to written communication by post.

    And try not to worry too much. You are doing nothing wrong. In fact, you are doing everything right... :)

    Sorry to hear you've had such an awful experience with Everyday Loans, that's really bad practice. Anyway - first off, block their number and do as advised, write and tell them to remove your mobile/home number from their records and that you will not communicate with them in any other form other than in writing. Ignore their comments and be assured that you are doing everything the right way. Just carry on the process with Stepchange and things will eventually tick along as they should. They are not going to suddenly prosecute you, nor will you lose your job. So relax :)

    At the end of May, SC told me not to send the paperwork back to them until I was ready for my DMP to begin, but I would have to contact my creditors because they wouldn't do it unless I was starting the DMP straight away.

    It is going to begin at the end of this month but now I've done all of the work with my creditors I'm not going to bother with SC - I'm going to self-manage.

    Best thing probably is to give them a call, or email them if you don't want to phone.
