For goodness sake you spent 99p and £2.50 for P+P. You didn't check that it was the correct size before purchasing, you didn't ask the seller any questions and now you want blood.
Of course you can report him if you want and fight it all the way to the European Court if you wish and I am sure the DSR will support you in that.
But in my book life is too blasted short, for an error of your own making, as I said before treat EBay like the small ads and you will get on fine, if you expect superior customer service go to a retail outlet and pay for it.0 -
I thought a standard Rubix cube was approx 5 inch cubed, don't know for sure - never owned one!~*Cerenia*~

Going off topic for the sake of my sanity... I once sold a small ornament that was 3 inches tall. I said in my listing the item was 3 inches tall and I got one of my only neutrals because buyer said it was smaller than she had thought it would be
I took great pleasure in putting a neutral back asking her how big had she wanted her 3 inch ornament.

Well if you already knew why ask here?
Others did try to help by saying that you were sold what was in the listing, but these comments are not the ones you want.
The other point being that to return at your cost will still leave you out of pocket as you already are by misreading the listing.
I always make sure when looking for anything on ebay I know what size and price it is by doing an online search. Most retailers give some sort of size and the price that it's now selling for. Leaving me to read a sellers listing properly before I bid.
If in any doubt about anything I use the ask seller a question tab. I then wait for a reply before I bid.
Sorry your not getting the replies you want but your asking for people's opinions here, and as you can see thats what your getting. Thanks for any help and advice given

See, http://www.oft.gov.uk/advice_and_resources/resource_base/legal/distance-selling-regulations/regulation-exceptionsThe regulations do not apply to:
- financial services
- sale of land or buildings
- purchases from a vending machine or automated commercial premises
- the use of a public pay phone
- auctions, including internet auctions
- rental agreements that have to be in writing (i.e. a lease for three years or more)

Look Nicky, can you please stop going on about me not liking your responses when you refuse to respond to my points repeatedly. Your "answers" have nothing to do with my questions.
Thanks Hintza, for being the only one here interested in acknowledging the way the DSR are supposed to work.
fwhorn, I'm sure you are trying to say something that makes sense.
Soolin, if you are saying that you would measure the cube that you don't have in front of you, and that you would measure the other full-sized cube that you don't have in front of you, I would say you are in the minority.
Most people at least agree with me on the point that the size of a rubik cube is not common knowledge. Its not exactly national curriculum stuff.
Yes, I am not doing this for the money, but the principle. I do believe that this seller listed the item in this way to mislead people into believing that what they were getting was a full-sized rubik cube, as I believe that most people here do. You may think this is "fair game" and that I have been stuffed. Good for you.
That is my motivation for sitting here putting up with this onslaught and abuse from others here who are only interested the seller's right to make money, whatever way. I suppose that is why so many here take such exception to the DSR. Because it protects consumers.
I am not a problem customer as some here have tried to smear me. I have 100% good feedback for the years I have been using ebay and had nothing but pleasant transactions before.
I notice that everyone here has made no comment on the relationship between ebay and paypal's to the DSR. Perhaps this is understandable if the people responding here are only interested in the rights of sellers or just can't resist the temptation to put the boot in to any buyer who stands up for themselves, or indeed anyone else.

deddog,
The DSR does apply to businesses operating on ebay, just not private sellers.0 -
Well just to put you right about us all being for the sellers on here.
I have NEVER sold on ebay I just buy.
As for Soolin's reply I would do the exact things she would do, as others have said too.
As for the seller trying to mislead, How on earth do you expext them to be any clearer.
Just to finish you have not had abuse just other's points of views that as they differ to yours you don't like them.
I will not post on your thread again as you seem to take offence to other points of veiws to your. Thanks for any help and advice given
