    so should i not appeal and see what happens with halfords?

    Let them sort it out? Or should i appeal it?

    Belt and braces, cover all angles. Depending on when their 28 day deadline for appeal expires, you could just hold back and see what transpires.

    Whatever you do, do not miss that 28 deadline as that opens the way to POPLA where you will, with forum help, get this cancelled. If you miss the deadline for the initial appeal and this doesn't get cancelled by Halfords, and you miss POPLA, you expose yourself for up to 6 years of potential hassle from HV and their debt chimps.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Appeal as I suggested but add that Halfords are also demanding the ticket is cancelled.

    So i had a look at when the date for appeal expires and it says that i need to appeal within 28 days from the date of the notice which is the 02/03/17 (so i have plenty of time).

    I will amend the blue template and talk about Halfords been the keeper/driver for the day. When I find time this week i will do that and post it here to see what the forum thinks of it.

    I have amended the blue template from the newbies page and added the bits in bold.

    "Dear Sirs

    Re: PCN No. ....................

    I challenge this 'PCN' as keeper of the car.

    I believe that your signs fail the test of 'large lettering' and prominence, as established in ParkingEye Ltd v Beavis. Your unremarkable and obscure signs were not seen by the driver, are in very small print and the terms are not readable to drivers. In fact I was not in charge of the vehicle and was not the keeper/driver - Halfords was, as they had the car and car keys for the purpose of fixing issues with my car. I have attached the bill for the repairs needed to fix the issues with my car.

    There will be no admissions as to who was driving and no assumptions can be drawn. You must either rely on the POFA 2012 and offer me a POPLA code, or cancel the charge.

    Should you obtain the registered keeper's data from the DVLA without reasonable cause, please take this as formal notice that I reserve the right to sue your company and the landowner/principal, for a sum not less than £250 for any Data Protection Act breach. Your aggressive business practice and unwarranted threat of court for the ordinary matter of a driver using my car without causing any obstruction nor offence, has caused significant distress to me.

    I do not give you consent to process data relating to me or this vehicle. I deny liability for any sum at all and you must consider this letter a Section 10 Notice under the DPA. You are required to respond within 21 days. I have kept proof of submission of this appeal and look forward to your reply.

    Yours faithfully,"

    What do you think? I wont send it this week but as per the newbies page send it on the 25/26th day from the notice.

    Also i will get the property management involved even tho halfords said they will sort it out, this is just in case halfords are unable to get it cancelled. I will draft a letter to them and again show you to see if it is ok to send.

    That's fine - and you can send it anytime soon, because 'waiting till day 26' only applies to windscreen PCNs.

    i went to appeal the pcn but there were options which i had to chose before i could click on appeal notice.

    the 2 options were
    Tick here to confirm that you were the driver and that the PCN you have received contains the correct information
    and the other option was
    Tick here to confirm that you were not the driver or that the PCN you have received contains incorrect information


    This maybe a stupid question but i should click the second one, correct?

    I wanted to ask this as the appeal template says that "there will be no admission to who was driving"

    Hi Everyone,

    I thought I give everyone an update.

    Great News Halfords was able to get all my tickets cancelled (4 in total) I received a letter stating that my ticket has been cancelled. It only mentioned one of the tickets (the newest one) so today I went back to Halfords to let them know that I have only received confirmation of the cancellation of one of my tickets. The guy said someone had 4 tickets and he had the same thing, Halfords contacted the parking company and they said that they will only send confirmation for latest ticket but all of them have been cancelled.

    Not sure whether it is worth contacting the parking company and asking for a letter to confirm all 4 have been cancelled? I might have been luck than Halfords for this confirmation. What do you guys recommend?

    Anyway, thank you all for your help!!!!! :T

    Save me money that I did not have to pay and did nothing wrong.
