UPDATE
Insurance have decided that I am at fault and have now sent a letter stating that as we breached the terms of the policy they were unable to provide cover for the incident and are wanting well over 10k in whiplash and car hire and solicitors fees which they paid out to the third party stating they have a right of recovery and want me to pay them back for what they have paid out have sent off an official complaint quoting all the relevant info given on this thread just waiting for a reply now will update soon0 -
Yes I quoted what he wrote and also quoted some more from the FOS site and also added all the links from which I got my info from just hope they agree with the complaint0

They will eventually agree they are wrong, it might need to go higher up in Ombudsman though.
I recommend you include the repairs or cost of your own car in your complaint as you are entitled to those as well0 -
Yes hope so and the insurance was only tpft but we did not need any repairs to our car as the only damage was a 4 inch scratch thanks for the excellent advice though0

UPDATE: the matter has now been resolved and have been sent an email stating; From your complaint, I note that you are dissatisfied with the decision because the vehicle on cover passed MOT days later, and you don’t think the lack of MOT at the time of the incident caused it.
Upon review, I confirm that I am in agreement of the above and will be overturning the Underwriters decision to refuse indemnity on your claim. We will therefore be dealing with your claim accordingly.
