    Thank you ever so much for clearing things up and the car did pass an MOT after the accident and nope they are not cancelling or invalidating the policy and nope it's third party fire and theft and my car doesn't need repairs they are just saying if theh pay third party anything they will recover costs off me as I had no mot and the accident had nothing to do with no mot or not being roadworthy just a simple bump they always seemed to be sneaky to me stating no you've breached contract so we shall recover third party costs and loss and damage from you

    This type of exclusion is loved by the cheap and cheerful Insurers even though they are not allowed to enforce it. They must catch out quite a lot of customers.

    If the FCA investigated them and discovered a lot of declined claims for this type of exclusion they could potentially be fined a considerable amount of money. The FCA are very hot on Insurers treating customers fairly and Insurers abiding by the rules.

    I would suggest you try contacting them on social media and pointing them to my post. This may save the time of making an Official Complaint as if someone with a proper knowledge of Insurance reads it they will know they cannot decline your claim.

    If you want to post your Official Complaint up on here for us to check feel free. It's very easy to write, just make it clear it's a complaint and point out they are acting incorrectly due to Ombudsman and FCA ICOBS and copy and paste my quoted sections.

    To make you realise you have nothing to worry about and for the benefit of Go Skippy / Eldon.

    Here are some other cases MSE have helped out with where Insurers tried the same trick.

    (Bear in mind that some of the older threads state an Insurer can reduce the payout for your own car if you have comprehensive. Since some of those posts the Ombudsman tweeked their guidance to in effect say there should be no reduction unless it was likely the car would not have passed an MOT and then a 10% reduction would be fair).

    Hi everyone, heres an update on the situation as of yet the insurance has not even decided who was at fault despite them saying they will by the start of the month due to strict personal injury guidelines and time limits but after chasing up they say they are unable to make any decisions as they are still waiting on more information from thr third party will keep everyone updated thanks

    This may be a stupid question but - there is a three year limit in which to bring a PI claim. Is there some other limit?

    UPDATE: Insurers have stated that from the engineers report on our car the damage the third party is claiming does not coincide and have now got a text from Examworks Investigators acting on behalf of my insurers to arrange an appointment so no idea of what they are and will do
