Although you would have been in trouble had you been caught driving uninsured, that is an entirely different issue to Kwik Fit not complying with the dd rules.
It's now up to them to pursue you, (not your Bank!), for any money they consider you owe them, now that your indemnity claim via the dd guarantee has succeeded, and then for you to dispute with them if you wish to.0 -

All I can see is the bank has refunded under the DD scheme. However, that is not success. That is normal. They do that regardless.Before you get a CCJ registered against you the creditor has to notify you they intend taking legal action against you. Only if you lost any subsequent court hearing (or ignored the court,) AND didn't pay the amount the creditor "won" in court within 30 days of the judgement would you get a CCJ registered against you. This would all take months not weeks, and there would ne no impact whatsoever on any credit applications in the "near future" as you wrongly suggest
The insurer can lodge a default without going to court. Court is for recovery. Lodging a default is just information recorded on the credit file.

Ive just looked and the fine is min £300 for no insurance so ive paid more haha (346.95)
I just dont like that they had set up a dd without me agreeing to it based off Old details i once gave them.
Ive rang my bank and they said it does fit the criteria for a claim inder dd gtee so they have put a claim in. Thy will put the £346.95 back to my account today, it will be left there and if they decide to take it back they can.

Technically it's saved you money, as you'd end up with 6 points for the IN10 conviction. That would add more than £46.95 to the premium over the time that it stays on your licence.
However, they still shouldn't have done it. They would be quick enough to issue multiple reminders if the payment had failed, by multiple methods of communication. One letter should not be sufficient to auto-renew a policy based on a direct debit that wasn't even ever authorised with them, but with the previous company that they took over. They have also added to the cost of their policy by taking the DD route (meaning they're entering you into a credit agreement) rather than payment in full via the card that they presumably have on file from when the payment in full was made with the original company. Surely any auto-renew should follow exactly from the last policy, meaning payment in full. I have known an insurer auto-renew a policy and send demands for payment later because the card they kept on file had expired.
Too many companies probably do try this; they are just clicking a button or similar so their loss is negligible if they later have to give back the money.0 -

I have never said i would withold the money if that was the outcome. If the prove they have done nothing wrong and in line with the dd gtee then i will give them the money back at the first instance.

Technically, you are now in default. Car insurance comes under a credit agreement when paid monthly. So, failure to pay allows them to lodge a default the minute it goes into default if they choose to do so. Much the same as mobile phone bills that go unpaid.
We have seen these on credit files. So, it can happen.
They do appear to have breached the DD rules as they should not have set up the mandate if you actually cancelled it at the bank.
What will happen next will depend on how kwik fit decide they want to treat it. It could range from them caving in completely right through to court action or somewhere between.
Your case is weakened by you not having alternative insurance. Had you bought elsewhere and duplicated then it is a much easier thing to resolve. Though the fact they set up the mandate again after you cancelled it at the bank is something that goes against them. The ombudsman have been known to rule against a firm where it did nothing technically wrong in an area but created unnecessary administration or difficulty. However, they have also been known to disregard side issues and focus on the main thing. Do you owe the money or not.I am an Independent Financial Adviser (IFA). I know dustinh im gutted that i didnt bloody realise that my insurance was due for renewal. One of those things that just passed me by. Very silly of me.
Can only see what happens now at this point. Tbh if they say they have been fair and are within the dd gtee then i'll accept that. Worth a shot though as i dont see that its fair what they have done.0
