    That is not what you stated in your OP, did you cancel the DD at the time.

    Ive just looked and the fine is min £300 for no insurance so ive paid more haha (346.95)

    I just dont like that they had set up a dd without me agreeing to it based off Old details i once gave them.

    Ive rang my bank and they said it does fit the criteria for a claim inder dd gtee so they have put a claim in. Thy will put the £346.95 back to my account today, it will be left there and if they decide to take it back they can.

    Lesson learned.
    - check bank acc more often
    - write fown when insurance due to renew

    The DD was resurrected when the customer thought it was defunct

    Neither the direct debit or the contract were defunct.
    The customer wasn't notified that his dd was to be used and how much was to be taken (see the OP)

    They may claim that but the insurer will have evidence that the letter was posted.
    The OP should use the dd guarantee which if you google you will see protects us from just what has happened (and is not just a protection against merchants using a dd when no instruction is in place as you suggest)

    They can use it. And the bank will refund without question. However, once it is looked into, the bank can take the money back from the account again if the firm shows it has satisfied the rules.

    However, there is now some confusion on the thread as to whether the direct debit was actually cancelled.

    Do note that this does not stop you owing the money. Kwik Fit could take you to court to get a CCJ registered against you. It can also damage your credit rating as the car insurance would fall under a credit agreement and it will be in default. Hopefully, you are not applying for a mortgage or any other credit in the near future.

    Canef yes the dd was cancelled when i paid the policy in full.

    Ive looked back and from oct 2014 - oct 2015 i paid by dd. They sent a renewal at that point i accepted the renewal but chose to pay that year in full, called and paid it, dd was canx at that point.

    The auto renew in oct 16 and dd is set up without my knowlege or say so.

    This is unnecessary scare mongering. (You seem peeved the OP has succeeded with their claim)


    Before you get a CCJ registered against you the creditor has to notify you they intend taking legal action against you. Only if you lost any subsequent court hearing (or ignored the court,) AND didn't pay the amount the creditor "won" in court within 30 days of the judgement would you get a CCJ registered against you. This would all take months not weeks, and there would ne no impact whatsoever on any credit applications in the "near future" as you wrongly suggest


    And the OP told us the money will be available in the bank should it have to be paid back!

    Why would it need to go that far? If they dont agree that they have broke the rules, they will take it back. Done. The money will be left there. If they think they have done the correct thing they will take it back. The end.

    I explained the CCJ system for the benefit of the (unnecessary) scaremonger, and anyone else reading that scaremongering post and being put off using the DD guarantee as a result!

    You forget the cost of increased insurance for the points you would have got for driving without insurance and the unquantifiable costs you might have been pursued for if you had been in an accident with a third party whilst uninsured. Insurance policies always outweigh the costs/potential costs of being uninsured.


    With that out of the way, hopefully this is all put to rest now and you can take it as a lesson learnt to try and avoid this hassle in the future :beer:
