  • Contact Consumer Advise on 03454040506 who will be able to check local Trading Standards and Environmental health protocols and pass the info to the appropriate body.

Action may or may not then be taken by one of those two bodies depending on whether is regular occurrence by trader, if they should have reasonably known etc (as stated above)

After that, move on. Tesco can give good customer service or not, not a lot you can do about that aspect of it.
  • Have taken back many things including:-
    1. Bottle of wine, "off" or "corked". Took one sip -that was enough...
    2. Grated Cheese, went mouldy in the sealed unopen bag before USE BY date
Always got refund, no questions asked.
I am a cow so cannot speak Bullshine but I do recognise its smell when I come upon it.

I wrote back explaining that I wasn’t really interested in the money but expected an apology considering the seriousness of the matter and reiterated that it wasn’t a best before date but a used by date on fresh produce.....

I personally do understand where you're coming from. An apology together with an explanation on how they are going to put things right so that it doesn’t happen again goes a long way with me as well.
.....Should I bother taking this further?...

My view it’s not worth the effort. You are unlikely to get an apology from Tesco, in my view it’s programmed into their DNA that the customer is always wrong. Vote with your feet and go elsewhere.

Good luck with your new baby!

I also check dates on stuff I buy like milk, yoghurt, cheese etc.
My local Tesco isn't great about proper stock rotation but 10 days.......

I too think Tesco should have been more apologetic and could maybe have made it a £5 voucher but it would be good to see the actual wording.
  • You can't have been too concerned about the use by date if you didn't even check it yourself!. Yes they should have checked it but why would you rely on someone else making these checks when it only takes seconds yourself.

Plus I don't understand why you want an apology, how will that change anything?.
Personally I think that customer service is focused far too much on making an apology and being sympathetic to the customers complaint. When I make a complaint I do it because I want to inform them of the situation so they can resolve it in the future and I'm not particularly interested in someone working for the company pretending they are sorry.

Its not my responsibility to check the dates...

Yes it is, it's one of the main reasons why the dates are there, so consumers can check them. Tesco are at fault, but so are you - have you issued an apology to yourself?
  • No its not. its illegal for them to sell food past the used by date, so i would never expect to need to.
    Thats rediculous

    OK then.
Why don't you write back to Tesco, tell them you are not happy that they didn't apologise to you and inform them that it is illegal to sell items that are past their 'use by' date as per the regulations you quote in your post # 9 and that you are going to inform Trading Standards.

Personally id be mortified if i took a swig of Orange juice id bought in good faith and it was 10 days past good !!

I do tend to look at the dates on stuff i buy, but i dont ALWAYS as i expect the retailer to not sell out of date stuff.

Its not so much the lack of apology here that would have bothered me here, more the apparent lack of them being concerned atall.
Being fobbed off the phone with a £1 voucher in the post would have left me feeling p155ed off too.

If they had assured me that this would be looked into then ok, otherwise i would have wanted a manager on the phone.

Each to their own though i guess

Well we are running on limited info. We don't know what the OP sent to Tesco (though I imagine she told them it was 'rediculous') we don't know what proof of purchase she provided, or anything.

We also don't know what Tesco actually said back and how courteous it was.
