Ownership of car

Hello all a new problem apparently I hear she's part exchanged the car for a new one
Now I don't know how that can happen if I'm still paying for the old car
Now what is that all about
Is that legal to do that even if she had log book in her name surely the buyer would be aware of the finance
Help0 -
Forget the above as same as
I haven't been in touch with finance company as yet but will be in touch once I lay my eyes on the new car with her personnel plates on it so hopefully will see over weekend but can she get a new car without paying if the finance0 -
Without paying of the outstanding finance0

Please answer the following:
1, How do you know the car has been part-exchanged?
2, Where is your car now?
3, Has the finance on that car been settled or not?0 -
I will answer all 3 question wen I see car ,and see if if her number plates are on there ,
She told me she part exchanged
Don't know where car is
And haven't rang finance as I need to know if the car has her private number plates this will be done by Monday
If I see her number plates on car then she's obs part exchanged somehow
Then we go to work ,as I'm guessing that's illegal in some way0 -
I would have thought that if the finance had been cleared - then the finance company would have confirmed to you as you are the signatory on the finance agreement. As Herzlos says - the finance company might well have accepted a clearance payment from a dealer who didn't question that Mrs K was trading a car financed to Mr K - but the finance co should still send the paperwork to Mr K. If they haven't - and you are still paying them; practically speaking your ex has stolen the vehicle, since she did not have the right to sell/trade it. You transferred the keepership - that's all. Then we go to work ,as I'm guessing that's illegal in some way
If that's the case - this is perhaps not going to be an agreeable separation!
Seeing the personal (sorry- "cherished") plates on a new car only proves the plates were transferred. She could have bought a new car by getting finance somewhere else and the old car is still around - she coild have SORNed it for a tax refund if organised enough or just dumped if it was tatty.
I think you should talk to the finance company first...I need to think of something new here...0 -
The thread's a week old and despite the OP posting he still hasn't confirmed anything that's of use. I'm out.0

So how do her personal plates prove anything? She could transfer them to another car at any time without disposing of the first one.0 -
Why not just ring the finance company now and sort it all out? Rather than putting it off and potentially making things worse?0
