    You're thinking would be wrong. The finance co. is likely to take a dim view of change of driver if they've not sought permission to do so. He'll likely be in breach of the agreement.

    C'mon guys, it's been stated a number of times now. Neither the OP nor his wife has any legal title to the car, the finance co owns it and the OP has he responsibility for it under the terms of his finance agreement. He has the right to take back the car any time he chooses.

    I would ask this though, does the finance co. know that the wife has the car?

  • Thanks everyone add this to the confusion she has apparently traded the car as a part exchange now what's that all about the finance company knows not about the part exchange but know about the log book but it's my wife so didn't really bat an eyelid and yr right but I'm seeing her tomoz to find out what happened to my car or the finance company

    That makes no sense. How do you "part-exchange" a car without the finance co. knowing about it, not unless the dealer didn't HPI the car but I find that hard to believe.

    The dealer she's part exchanged to would need to HPI it and clear the finance. I guess if she's the registered keeper that might have been enough for them to clear the finance.

    If that's what's happened then you're sorted - the finance has been cleared and the car has been disposed of. Will you get any money back if you were in equity? I doubt it. But if it was in negative equity then you'd done pretty well.

    I agree, if they've settled the finance, the OP hasn't really been that clear on that.
