LOL. They will send a template rejection letter ''offering'' the chocolate teapot of IAS. Do not do that; absolute waste of time as explained in post #3 of the NEWBIES thread.

    Will do.
I will get this new letter to co-op reworked and see what is what.

Hi, I've had contact back from NPE after my initial letters following the template.

It looks to be a straightforward response, they have provided more photos of the vehicle etc. none of which specifically prove whether anyone was in the back of the car or not.

They have offered again I pay before a certain date at a 'reduced rate'.

They have cited Parking Eye v Beavis case as reason why I should pay.

They have also put that I should send a 'contest' to IAS.org within 21 days from the letter date.

Therefore, what is advisable that I do next?
    Thanks.

Hi Coupon-mad, sorry, I have just re-read the sticky thread.

You advise ignore IAS while some others suggest to appeal again.

Also, I have moved house so they are writing to my old address - what do you advise regarding this?

Ah, so you should write and say (effectively) 'thanks but no thanks' to the kangaroo court of IAS and rather than incur any further costs you suggest if they believe they have a claim in law, they should proceed without passing the alleged 'charge' from pillar to post because you will not be responding to debt collector letters.

Then tell them the new address for service of letters (which does not have to be a UK address, and it is the address at which you can reasonably be contacted). Forbid them to write to the old address or you will report them to the Information Commissioner for data misuse and breach of the DPA Principles.

    Thank you,

Is there a template for the 'thanks but no thanks' or should I just post my version here for checking?

    No template!
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

    Dear All,

I've had a debt collector letter through today - just wanted to check this is not of concern.

After having no heard from them for nearly 3 months (as you can see from the last post here). I had a letter today from a debt collector called, Debt Recovery Plus Ltd.

They are now wanting £160 (up from £60) and seem to offer every payment method under the sun for paying them.

They have cited a court victory in 2015 on the letter and linked to the following - https://www.supremecourt.uk/cases/uksc-2015-0116.html

    Parking Eye vs Beavis.

    Continue to ignore?
Thank you for the help once more.

What does your research on drp tell you? Or indeed any debt collector?
  • I have a very similar case; I have received a NPE parking charge at Earlham Green (East of England Co-op) Norwich, NR4 7TE. Reason for issue is Parked in a child and parent bay whilst unaccompanied by a child 12 year or less. I have two kids; 4 and 6 year old. It was 2 October at 19: 25 and 19:26, just a couple of minutes and only younger one 4 year old was sleeping in side(rear) car. On their photos she was shown.
I've revisited the Earlham Co-Op shop's parking to check where was the notice and camera.
I couldn't clearly see the notice in the late evening/night and camera installed too high away.
I have read so many complaints about NPE parking charges and appealing doesn't work (They don't listen and the payment time passes they charge even higher amount anyway.)
It is really frustrating and feeling they are scamming local ordinary people.
