  • Hiya,
    We recently had to move back to parents house after losing our home and my subsequent bankruptcy. My husband still has debts which are being paid through debt managements company.

    yesterday my husbands parents neighbour called round saying a company had contacted him(and also told him they were a debt tracing company - thanks for letting the street know - data protection anyone?)

    We duly phoned them and they said they were working on behalf of a company - but they would not say who, why and what it was about. I only found out that they were j2 solutions by googling the phone number! They were exremely vague and have advised that who they were working for would be in touch by letter.

    We have only recently moved and are curently getting all our mail redirected, and debts are as I say being dealt with via debt management.
    I am really scared that someone is going to come knocking now, my husbands dad is not well and we dont need the worry of this as I dont know what it would do to him.

    Any advice would be gratefuly received I am very scared.

  • I had a letter on my door matt yesterday from J2 Solutions. It was addressed to "The Occupier" at my address.

    It then says:

    Dear Sir/Madam

    Subject heading of Someone's name (that I've never heard of) and my address

    I am attempting to contact the above named about a peronal matter.

    If you are the person named above or know how I may contact this person, I would appreciate it if you would contact me in confidence on the number above upon reciept of this letter.

    Any information you are able to provide will be treated with the utmost confidence and your assistance will be greatly appreciated.

    I look forward to hearing from you soon.

    So my question is, how do I deal with this? I have lived at the address more than 8 years and I own the property. To my knowledge, the person named in the letter has never ever lived there. I know most of the previous names back to when the house was built and the one in this letter doesn't ring any bells at all. Should I write to them and tell them this or just ignore the letter?

    Should I be worried that the person named in the letter is using my address for debt?

    Any info please. I too found this thread by googling J2 Solutions!!!

    By the way, I don't have any debts except my mortgage so there shouldn't be anything on my credit report, should I check it anyway?

    First of all - just ignore the letter. If J2 continue to write to you, then simply write back and tell them that the person they are looking for does NOT live at this address and tell them to STOP writing to you.
    Do not give them any of your personal details - they are part of a particularily nasty 'organisation' that goes under the name of MacKenzie Hall. This example of the worst form of the already questionable function of 'debt collection' attempts to specialise in collecting 'debts' which are, legally, no longer collectable and will stop at nothing to try and 'ensnare' unwitting victims into their trap.
    If you do write to them (NEVER phone them) do not sign your name - just print it.
    I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
    If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

  • Thanks for posting all of this...I have been having quite a time with the previous owner's debts being chased and ordinarily I phone the company to advise them to stop sending me letters but I shan't do with this one!
  • hi there, after some advice pls have had a letter from a company called clarity offering me a settlement figure for a debt from carbot who iknow nothing about not sure what its for either and it says i have seven days from date of letter but only received it today and its dated the 3rd oct! also says in bold writing at bottom of letter if they fail to hear from me they will either instruct a doorstep agent or instruct a solictor tocommence legal action ! can they do this when this is irst letter i have had from them? many thanks for any help xxxxx:confused:

    I wouldn't worry unduly, ff - this is a 'typical first letter' from the ilk of clarity. IF you owe money to clarity or Cabot (another debt collection agency) then they must prove that you owe the money and that they are legally entitled to 'collect' the debt as it will be either on behalf of the original collector, or a 'debt' (possibly unenforceable) that they have 'purchased' from an original creditor.
    They can not make threats of legal action without having first told you what this 'debt' is, and gving you the opportunity to dispute it.
    As far as 'doorstep agents' are concerned, again do not worry - it is par for the course for debt collection agencies to threaten home visits, yet they rarely do call as this costs them money. However, in the unlikely event that someone does turn up on your doorstep, you need to be aware that they will have the authority, and unfortunately the persistence, of a 'Double Glazing Salesman'. They will have no automatic right of entry, peaceful or otherwise, to your home, nor will you be under any obligation to discus the 'debt' with them, and they must leave immediately when you ask them to.
    The way that 'Debt Collection Agencies' are supposed to work, is spelled out in the Office of Fair Trading Guidelines, which can be viewed (I suggest you download a copy) on the following link:

    Also, and before you even consider any 'settlement offer' you need to establish the validity of their claim. You can do this by requesting a copy of the original executed consumer credit agreement and a 'statement of the account'.     Since you say that you are unaware of any debt to either Clarity or Cabot, it may well be that the 'alleged debt' is either not yours, or is a very old debt which may even be unenforceable through the courts - Cabot certainly appear to specialise in old debts. In England and Wales, if a 'debtor' has made no payment towards, or acknowledged, in writing, a consumer debt for a period of six years (five in Scotland) then that 'debt' becomes Statute Barred and, providing the debtor informs the dca/original creditor that he will not make any payments towards the 'debt' as it is 'statute barred' then that creditor/dca can no longer pursue the debtor through the courts and should cease all other attempts at 'collecting' the debt:

    As the whole area of 'Debt Collection' is such a minefield, and the fact that you have mentioned two of the most dubious 'inhabitants' of that murky 'underworld' may I suggest that, before contacting clarity or Cabot, you phone one of the Debt Counselling Charities, such as:

    We tracked them down to J2 Solutions. We owe no money, except mortgage and credit cards. But, we are wondering about a family who recently moved next door but one.

    don't bother calling them, or if you do, just say you don't know who lives there.

    Why do thier job for them?

    J2 are Mackenzie Hall, its just another name they use. A lot of debt agencies have various company names registered for different parts of their business which can also make it difficult to take them to court for bad practice.

    J2 tend to do the tracing part and use the lectoral role and companies like equita to match potential names , hence why so many people get letters chasing amounts that they do not recognise.

    Either send them a letter advising that no one of that name lives there and advise them to check their records or just mark 'Not known at this Address' on the next received letter. Unfortunately they are not very good at listening so don't expect them to give up like that. Yes you could just ignore them but it won't stop until you get the message into their thick heads.

    Don't phone them though as a lot of their staff are not very pleasant - well for Mackenzie Hall anyway - see my post on thread http://forums.moneysavingexpert.com/showpost.html?p=14254385&postcount=255
