But he wasn't stopped because there was "evidence" that the OP wasn't in control of the vehicle, he was stopped for allegedly using a mobile phone. You can't suddenly then invent evidence to support a different offence. I'm sorry but I think most magistrates would see through this which is why I very much doubt the OP will hear from them again.

I think he will hear, mobile phone use is being rammed down officers throats this month. I'm sure the tor will be written up to recommend further action.
  • Stupidy on the police part. If they are defining anybody who doesnt have both hands in the wheel, as not in control of the vehicle, then everybody who owns a manual car should receive an MS60 by default.

    Absolute scum.

If they're holding something they shouldn't be then I agree.

Officer thanked me for my cooperation and said I would hear back from the traffic unit within 14 days as to whether they will take this matter forward or not.

    !

Doubt whether the copper would have said that, they have 6 months to decide not 14 days.

    I smell BS.

That's fair enough, your entitled to your opinion.

Only reciting what was stated at the time. I have no reason to alter or modify the actual account.

Would the Police have stopped you if you were smoking a cigarette?

I completely agree with you mate, theres nothing wrong with smoking / vaping while driving. It doesn't affect your vision and doesn't affect your control of the car any more than changing gear or winding down the window or scratching your chin or anything else.

I recall being in the car with a good friend of mine when he was fairly new to driving.

Went to throw his cigarette butt out the car, went into the hedge as his left hand naturally dropped as he used his right hand to throw.

Given these items can spit hot liquid and explode. Not sure what ever the road conditions they are suitable when driving.

From what i've been reading, I would have been better off using a mobile phone, as the CU80 offence seems to have less effect on insurance premiums then the ghastly MS60.
That was certainly the case a few years ago - but AIUI the MS60 code is no longer used for not in proper control. Instead CU80 is now used for both mobile phone offences and not being in proper control. (Linky)

I have to take umbridge with you final paragraph.

Spit hot liquid? Never heard, seen or experienced that.

Any electrical device has the potential to explode. Even more so if it was in someones pocket.
