But he wasn't stopped because there was "evidence" that the OP wasn't in control of the vehicle, he was stopped for allegedly using a mobile phone. You can't suddenly then invent evidence to support a different offence. I'm sorry but I think most magistrates would see through this which is why I very much doubt the OP will hear from them again.
I think he will hear, mobile phone use is being rammed down officers throats this month. I'm sure the tor will be written up to recommend further action.0 -
Stupidy on the police part. If they are defining anybody who doesnt have both hands in the wheel, as not in control of the vehicle, then everybody who owns a manual car should receive an MS60 by default.

I completely agree with you mate, theres nothing wrong with smoking / vaping while driving. It doesn't affect your vision and doesn't affect your control of the car any more than changing gear or winding down the window or scratching your chin or anything else.
I recall being in the car with a good friend of mine when he was fairly new to driving.
Went to throw his cigarette butt out the car, went into the hedge as his left hand naturally dropped as he used his right hand to throw.
Given these items can spit hot liquid and explode. Not sure what ever the road conditions they are suitable when driving.0 -
