Not in proper control of vehicle

  • What frustrates me is that the evidence of the officer will be "He was driving with only one hand on the wheel and as such was not in proper control of the vehicle".

Yet you only have one hand on the wheel when you are changing gear, adjusting the mirror, pulling down the sun visor etc.
People with one arm are permitted to drive automatics.

This seems to be a catch all offence, which has no definition. I was driving along in a straight line, obeying the speed limit. I was using my mirrors as I saw the blue lights a few cars back. I indicated and pulled over safely. I was in full control of my vehicle.

From what i've been reading, I would have been better off using a mobile phone, as the CU80 offence seems to have less effect on insurance premiums then the ghastly MS60.

I completely agree with you mate, theres nothing wrong with smoking / vaping while driving. It doesn't affect your vision and doesn't affect your control of the car any more than changing gear or winding down the window or scratching your chin or anything else.

    Are you joking?

Have you ever seen someone using a modified vape? They could fill a car with a dense fog in just a few seconds.

I agree with you on that. The amount of vape the modified devices give off would be like driving through fog.

Mines a very low end non modified one.

To be fair I don't believe "driving with one hand" is an offence of any sort. Its all about the context - if you're distracted because in your other hand is a phone, etc.

I agree they should not be able to charge you for anything without evidence - if you get a fine for parking, or speeding, or going in a bus lane, they always have evidence.

If they do fine you, and they provide no photos or anything, then I'm sure you can appeal it.

I suppose that is true. But we're talking about control of the car not visibility

The difference is you were holding something, that offence was used for mobile phones before a separate offence came in. Plenty were convicted for simply holding a phone.

If it means you aren't in proper control, absolutely.
