Hi,
I am now being sent written confirmation that the entirety of Dumballs Road is a public highway, just hope it arrives soon enough. Looking at the picture taken by the UK Car Park Management photograph that they're using my car can be seen to be clearly parked on the road and not the concrete dropped pavement. It'll be interesting to see where this goes.
Thanks again for your response.0 -

I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

This will be about the pavement on which cars are parked. RTA says everything up to the curtilage is covered by a TMO. UKCPM are saying the pavement is within the curtilage so it is down to a toss of the coin.
Basically with any boundary question, the tolerance between boundaries is a couple of feet i.e. the width of a pavement.
You could play double or quits and start a counterclaim against them for misuse of your personal data, get it heard at the same time and come out £500 up or £400 down. This is a system account and does not represent a real person. To contact the Forum Team email forumteam@moneysavingexpert.com0 -

Alternatively you might get lucky and they see your defence and discontinue if they detect they are onto a hiding, but don't get your hopes up, I get the distinct impression they might not read everything that drops through their mail box
All joking aside, once you have your evidence and it proves all this to be true then you may have options (e.g. issuing a drop hands offer basis this evidence and if they ignore it pursuing more costs than you normally might get away with).
As IamEmanresu states - this comes down to exactly where the car was parked. Can you get the image hosted so we can see it?0 -

The feature of a lot of UKCPM cases at the moment is they are "self ticketing" cases. Often the site owner has issued the ticket and has no real clue about whether they are ticketing on their own land, and particularly if the signs are clear. The ones in GSV are not really up to scratch.
IMHO worth a punt if they intend to make you spend a day in court. This is a system account and does not represent a real person. To contact the Forum Team email forumteam@moneysavingexpert.com0 -
This is presumably where you were parked?

I'm actually very close to said spot. I can certainly get some clearer pictures of the signage if you're unable to.0 -
Hi all,
I've added this link to imgaes of where the car was parked, the image taken by the parking scammers and one from google images.

any opininons would be appreciated.0 -
Looking at the Google image, it appears that the faint outline of parking bays and a central line road marking can be seen, but are essentially worn away. On that basis there may be scope to argue appropriately parked in a designated bay.
The car in the PCN photo may, depending on how one looks at it, have mounted the kerb. That's unhelpful if correct, but the onus is on the claimant to provide better photos if so.
Finally, perhaps you can clarify, but the Google image is dumballs rd, whereas the ticket says Curran road - the parallel street. Have they named the incorrect "relevant land"?0 -
Gmansquared, you would be wise to blank out your VRN from both the image and text, and the PCN number from that PCN picture.0

Hi,
Yes they have named the incorrect road, i've no idea why they would have done that.
