    I had a warning and a 'desist' note a few years back for an item but at the time, and still today there are dozens of other sellers listing the same item.

    Yeah, but how can fitbit not allow it? I get that they can not offer a warranty etc, but not allowing the sale of something legitimately come by seems to be quite unfair. I don't know if it's illegal, feel like it shouldn't be.
  • Buyer didnt send the Fitbit back to me, I phoned ebay this morning, its over 14 working days since she requested return and so ebay have closed the case and will be releasing the funds to me within 48 hours. Case closed (I hope).

    Good result. But why has your buyer not returned it if Fitbit have disabled it? It seems really odd that they don't want their money back for a useless piece of plastic.
