A few companies do that, it is often a minefield knowing what you can and can't sell on ebay without the original company getting upset. Try Microsoft for instance, pull stuff first and ask questions later.

Nothing illegal about it.

Purely a commercial arrangement between eBay and Fitbit that eBay will not allow sales of Fitbit's products on eBay's platform. You'll have agreed to it when you accepted eBay's T's & C's.

Surely this only applies to NEW goods - which i suspect is the issue here.

If the O/P was selling a second hand one there wouldnt / shouldnt be an issue

The OP said it was new and unopened. Assuming this is how they listed it.

Yes, exactly. Thats my point - the O/P here seems to have been selling a new, unopened item thus the manufacturer has quiped because they're not an authorised reseller.

It would be interesting to know if the O/P sells stuff regularly on ebay and thus could be considered a trader?

The comment i was quoting and referring to was suggesting that a manufacturer had the right on ebay to object to ALL sales of its items.

We all know those that continue to get away with such restrictions but surely Fitbit is dropping the level a bit of those that are full of their self importance/brand value

Yes, of course they do. It's a commercial agreement between eBay and the manufacturer - they can do whatever they like, regardless of whether the goods are new or used.

No. There's nothing stopping you from selling a new or second-hand Fitbit elsewhere. But you can only sell items on eBay in accordance with their Terms and Conditions, which you agreed to.
