ebay return, buyer says its counterfeit

    Ebay are quite hot on VERO. However I did manage to buy some branded underwear at Xmas from a very famous brand, and before I could even leave feedback the listing had disappeared.

    Fortunately the company involved hadn't managed to disable the pants remotely.

    Of course there is absolutely no reason why they can't resell it. They just can't do so on eBay.

    Which is a perfectly sensible and legitimate commercial decision by eBay.

    So why do ebay allow the items to be listed in the first place?

    If you enter "fitbit" as the keyword of what you want to sell, it prompts you with a variety of common fitbits and defaults to put it in the "smart watches" category.

    Why not just a message saying "The sale of Fitbits is prohibited by the manufacturer"?

  • From what I can see eBay doesn't prohibit Fitbit branded items (happy to be corrected if someone has a link to an eBay policy page specifically stating they are prohibited).

    VeRO is a different issue, it's there for rights owners to report listings which infringe their intellectual property.

    A brand not wishing it's products on eBay is not what VeRO is for.

    Without a link to the policy stating otherwise, you are free to sell whatever you want in terms of brands when correctly sourced within the EU. Sadly if the brand abuses VeRO eBay will not get involved and you are left to argue with the rights owner.

    It might the status of the seller. I tried to sell a cosmetic product that I did not want and came as a free gift on my personal account. It was removed under Vero saying only business sellers were allowed to resell the product. I then listed it via my business account and it listed and sold no problem.

    I sold my Fitbit Charge HR at around May last year without any problems. It has been used, so maybe that's the difference, but at the time of the sale there were plenty more people selling new and used Fitbit watches.
  • Here is an update. I have been told by ebay to pay for return postage and then give a full refund when the fitbit is returned. Fitbit wont speak to me because she registered it, but they blocked it cos it was sold to me and I am not a reseller. I have a personal (?) ebay account, I sell about 6 things a year (I buy loads of stuff LOL).

    That's strange... I'd understand if you were selling lots, but just one ? I guess the question is how you came by it and to sell it. They can't just block devices not registered by the original buyer - what about gifts? Still something strange about this. I wonder if fitbit have got the wrong end of the stick somehow .

    If fitbit do not allow the sale of new ones unless by an authorised seller then it doesn't matter to them whether OP was selling 1 or 6 of them. He was just unlucky that it was spotted somehow.


    I had a warning and a 'desist' note a few years back for an item but at the time, and still today there are dozens of other sellers listing the same item.
