    What you would do is irrelevent, they are entitled if they so wish to ensure there car is 100% restored by a proffessional

    Im sure you wouldnt mind them doing an easy repair, but as someone who has had the same done and had it bite them later i dont blame them

    If that car is on PCP etc or even if it isnt parking dents/scratches lower value, T cutted or not

    My advise would be always to photograph and get witness names etc.. My hubby has had real probs lately in Jan he caught a cars mirror (he drives a HGV) Witnesses all said that the car in question had tried to go round hubby on the inside even though it was clear he was manourvering. Well hubby took photos of mirror, name of driver (no passengers) and took names of all witnesses + roadlay crew. Didn't hear anything until june this year, claim had been made for damage to whole side of the car, so new wings & doors, whiplash to 2 passengers as well as the driver. Of course hubby could prove they were tryin it on but still had to go through the rigmarol.
    Not saying that is what has happened here but merely trying to say that it lies with both parties to protect themselves in any kind of incident no matter how big or small.

    Why is it a stupid claim?

    You wife damaged someone's property.
    If you damage something you should pay to put it right.
    They should not have to inconvenience themselves or put up with a DIY repair (which may devalue their car).

    They are fully entitled to reparation for you wifes mistake.

    Personally I'd let it go but my car's an old banger. I don't think anyone else is
    or should be obliged to just put up with the damage that your wife did.

    Perhaps you need to address either the care she takes and/or your choice of parking space.

    Rather harsh I think. OP is after advice not criticism.

    OP has at least been honest and left details for TP. It could have been very easy for OP to drive off (as so many people do!!). I personally am tired of people banging doors into neighbouring cars without any care. However, this must have been honest accident if OP willing to sort out with the third party.
    Advice:
    The third party can claim through insurance, but OP should contact his insurers and say that he wants the chance to settle the claim himself once it has been agreed. I work for an insurance broker, and if a claim is minor, some insurers offer the policyholder the chance to pay for the claim (i.e. reimburse the insurer), hence not affecting any no claims bonus. Worth a try.

    Someone did exactly the same to my car in a car park this morning.

    The mark will come off with around 10 minutes of effort and a bit of T-cut.

    If the damage is as you've stated - i.e. you've just left a bit of your paint on their door - they ARE being stupid by pursuing this through insurance.

    I am sure that they are stupid because they are going to have to disclose this as a no-fault claim for the next 5 years and they'll probably end up paying more in insurance as a result. All to save 10 minutes of effort.

    I am willing to pay for the damage, I just thought it would have been better to pay without going through insurance.

    I was only trying to find out how do insurance company deals with such a claim. I left my details and if that's the way then be it through insurance. Stupid claim I meant, if it was an accident by driving it doesn't matter.

    Stupid way to pay for extra insurance in the future, there was other way of rectifing the mistake I thought.

    whenever i park in a carpark even if mine was the only car in the carpark when i come out of the shop some numpty has parked too close to me it p*sses me off

    As T-cut removes the paint I think someone that doesn't know what they are doing could damage the car.
    Someone not DIY minded or not able bodied might not be able to do it.
    I think you need to get a life it must be great being so perfect

    I never said I was perfect, but if I made a mistake I would be prepared to pay for it.

    I have an old car and I have a great life with it as these kind of little dings don't worry me at all. I find it quite liberating not to have to worry about what happens to the car.

    I agree with you David, but unfortunately (not my rules) you still have a duty of care to their property. I find this really annoying but it's the law.
    There are several options open to you though.

    You could move the car before letting passengers in or you could climb in from the other side (if able-bodied).
    If you really are hemmed in and can't get in without damage then you should attempt to contact the owner.
    This can be very inconvenient I agree, but criminal damage is not justified even if they are a complete numpty.
    I totally agree with you about it being a real pain but that's the law I'm afraid.

    I'm not quite clear on why you say that or what point you are trying to make.

    Are you saying that you believe that damage is justified if people are "numptys". I'm afraid the law says otherwise (not my rules).
    The OP is legally obliged to put the damage right.
    Are you saying you don't agree with this and you would be happy if someone walked away if they damaged your car??

    I've just had another thought.

    I know some people think it's OTT for such a small amount of damage and I have some sympathy with that view.

    However it's possible that this is a company car, or leased car, borrowed etc. that the victim needs or wants to return in perfect condition.
    Perhaps because they will be penalised financially or feel guilty because it's borrowed.

    Personally I'm really rubbish at DIY and I wouldn't attempt a DIY repair on something like this (as I know it could end up worse that when I'd started).
    Not everyone is well equipped in that direction.
