Touched other car by opening door

Hi

Advice required, we were parked in a shopping car park. My wife opened car door and touched other car parked next to it. The other car had a small white mark (colour or our car) the size smaller then this star *.

The other party is claiming off our insurance, not sure how the case will be handled. There was no dent or anything, just that small mark. I am sure access will cost more to fix.

How will insurance view such claim.

Any advice

  • Private property! Car park bumps don't count! I think
    Sig ah Sig Ahhh
  • Wont the size of the excess far outweigh the cost of the repair.
    Buy them some T-Cut
Did you manage to photo the 'damage' in case they are trying it on.

    Er, no.

The fact it occurred on private property is irrelevant. The OP is still liable for any damage they caused to the third party's car.

Your best bet would be to contact the third party and try to sort out a private settlement.

No I didn't take the photo, which is a shame, I left my phone number hoping they phone, but they didn't bother phoning, now I got a form of from insurance to fill in about accident.

In the form it already is filled out that my car is off road.

I have no contact detail of other party. So just have to wait and see, I thought excess will out way the cost.

I was wondering how would their insurance view such a stupid claim?

On the form it states '"third party alleges Insured opened door onto third parties parked vehicle"

Would you think it was a stupid claim if it had been the other way round? I suspect not.

I would but they are being such I pain. I have emailed yesterday my insurance asking them if the other party contacts me. but not sure if they are willing or not.

Yes i would. Some one marked my parked while parled on road. Left their telephone number, I never bothered even contacting them. I had a mark on the bumper.

  • Also I am happy to fix the mark. But it's the way the party is going about it.

I've had more serious bumps than that
Some bloke opened his car door as I was driving past

In the last month picked up 2-3 scratches in car parks

Bottom line to me is: it's not worth going through the hassle of insurance to claim.

I figure when I come to sell, I might just get them all done in one go, paid for by myself ... or maybe just T-cut them out.

    Life's too short.

Although, that said, maybe the other person's car was brand new, precious (pen1s extension), best car he's ever had, loaned up to the hilt on it ... and has no money to make his baby perfect again.

    Everybody's situation is different.

Well unfortunately it looks like it's out of your hands now. It sounds as if there is no dispute at all over liabilty; the third party are quite entitled to claim through insurance if they wish.

I know it's probably obvious with hindsight, but did you not take the third party's number at the time? Because no matter what the other party says about sorting it out privately at the time, they invariably decide to go down the insurance route unless you really go out of your way to sort things out promptly.
