    I'm trying to work out if you meant to say "Sir", or whether there's an invisible but not silent "h" in the first word to the Judge .... :eek:

    an email will just result in one back asking you to post a form , the address I have given , will take you to the correct department , and they like signatures on letters , as it covers them for DPA , signing an email is hard

    A Defendant tried exactly that last month, backed with an Incident Log Number from the Police from 2015, where she'd reported that her plates appeared to have been cloned because neither she nor her car had visited the city in question.

    The PPC rocked up, insisting on a Crime Number and the Judge believed that was needed because the Claimant said it was! In fact, you don't get a crime number for a situation of alleged cloned plates because nothing has been stolen from you/there is no crime against you. You don't even get a crime number if the cloned car is then involved in criminal incidents, unless those crimes are against you. I know that because another MSEer I am helping, mentioned to me that her car had been cloned too, a while back, and the ringer vehicle was used in a crime - but she too only got an Incident Number. You'd get a crime number if your plates themselves were physically removed from your car.

    Anyway in this case I've mentioned (which was on here and I've dragged off-forum) the Judge gave the Defendant a chance to get the crime number and he adjourned that hearing for her to do so, but held her liable for the 'wasted' £75 costs for the poor Claimant's wasted first hearing (awww...diddums...the poor 'innocent party' Claimant).

    So, I am now trying to rescue that poster off-forum, at the eleventh hour, before the next hearing. And like 99% of the PPC victim population, she does not need a so-called 'lay rep' but she does need to know she needed to say/know/bring evidence for more than she did the first time.

    So, no, it is not enough to turn up and say 'that's not my car'.

    Don't you worry...it is in hand. I am trying and the Judge will be informed of this on the basis that the PPC was trying to mislead the court/waste court time, as well as send the consumer on a wild goose chase.

    It is very late to rescue the case but I am trying - and assuming the Judge agrees, the door will then be open for the lady to sue the PPC and the landowner for data processing misuse (they were told in 2015 the car was cloned and had been given a Police Incident number) and for harassment...although technically I think 'harassment' may not be a small claims issue, might need a different court level. DPA misuse is better because that includes distress without having to quantify loss.

    I have only just seen the post about getting a certificate of posting...................I didnt!
    How long do I wait for DVLA to get back to me? Im so worried I am going to have a court summons any day as I havent contacted UKCPS at all about this matter not being my car.
    I am sorely tempted to ring UKCPS and say it wasnt me and get it sorted that way rather than just ignoring it until I hear back from DVLA. Its less hassle and stress to me. Im not a youngster and this is affecting me badly.
