Parking charge notice

Hi guys hope someone can help. Had a letter yesterday 21st Dec 2016 off a company called TNC. They have wrote to me and said a vehicle registered in my name has committed 4 offences totalling 400 pounds in total. Three of these offences were in 2014 and one in Jan 2015. They have acquired my details from the DVLA because they cannot trace the driver. I was at the time the registered keeper of the vehicle but not the owner. I don't know who was driving the vehicle at the time so I can't help them on that.
Obviously this has taken them a long time to contact me directly at my home address and they are now asking me to pay the 400 pounds in full or name the driver. I have had no correspondence off the actual parking company called Autosec before this letter as I had no idea about any of it. Hope someone can point me in the right direction.

    Is this letter headed up 'Notice to Keeper'?

    We've had other ones this week about TNC sending a NTK two years too late. Complaints need to be made to the BPA (if the parking firm, not TNC, were BPA members). And the DVLA for releasing data to TNC two years too late.

    Don't ignore it nor pay it. Proactively COMPLAIN. The parking firms had just six MONTHS to get DVLA data, not years. This is data misuse and you may be able to get damages in 2017 if you are so minded.

  • Hi thanks for reply yes the letter is notice to keeper. Could you tell me which is my best course of action first. Do I correspond with TNC or not or do I complain to the BPA and the dvla

    firstly you need to get your ducks in order and find iut WHEN your details were accessed .

    WRITE a letter

    write a letter ,and send this by first class post after filling in the blanks

    Example Letter

    [Your Address]

    DVLA Vehicle Record Enquiries section

    Longview Road

    Morriston

    Swansea

    SA99 1AJ

    Dear Sirs

    Re: VRM AB12 XYZ

    As the Registered Keeper of the above VRM could you advise who has accessed my personal details with regards to this marque, how often and when did the DVLA send the keeper details out. Please advise the information with regards to events between xx/xx/xx/ and xx/xx/xx.

    I understand there is no charge for this information and look forward to your speedy reply.

    Yours faithfully

    Mr Registered Keeper

    fill in the dates (a few weeks before first ticket and a few weeks after last ticket **** actually NO , put the end date a day before the TNC letter was posted !!! , this way you find if it was autosec or TNC that got details

    await answer (new year ) from DVLA , then you can go on the offensive armed with data

    as you can read on the other thread , autosec is on his way out , and trying to get money quickly , TNC are doing no pay - no fee , so its a win for both of them if even 10% pay up ,

    you might also be interested that the company "autosec or autosecurity was not registered with the ICO when this incident took place , therefore if they have applied for info , they are in trouble

    No offence has been committed, follow the advice above, and also go for the landowner who is/are jointly and severally liable for the actions of their agents ( in this case the parking company)
    From the Plain Language Commission:

    autosec are not TNCs agents?

    they HIRED TNC , therefore they are TNCs employer , not agent

    as posted above Autosec were not registered with the ICO at the times of the incidents , so this could get very messy for them?

    why they have just registered this year is another mystery that may come out with the dirty washing

    it would be nice if autosec has applied much earlier (at the time) as questions could be asked of the DVLa why they allowed a company that was not ICO registered have the info , or indeed if asked for recently (by TNC) why they released details for an offence that was committed mire than 6 mths previously

    I smell trouble ahead

    I suspect the ICO registration has been done to muddle the waters when investigated

    wonder if the BPA know , or indeed are happy to allow a company that is not registered with the ICO on their books

    time to get very nasty with Mr Peter Delgrosso , seems that you need to contact him as date controller and ask for ALL info he has on you

    this is going to hurt , he only registered in 12 October 2016 , so how can he produce any info from before that date , failure to produce any info held on you is an offence , so is failing to register with the ICO

    on form v888/3 , the parking co is asked to dtate the reg no with the ICO and the expiry date , so how did autosec do this?
