Which is more illegal? Lane Hogging? Or undertaking somebody lane hogging?

So both are classed as illegal now but there's a stretch of motorway that I use pretty much everyday that goes from three lanes, to two and back to three quite a lot, and there's so many drivers who hog the second lane and I have no choice but to undertake them somehow..
So I've been curious, as both of us would be breaking the law, but who is actually more in the wrong?

There is no degree of illegal. It either is or it isn't.0

You are, there's no doubt about that. Whether someone is 'hogging' the wrong lane can be very subjective and different witnesses will give a different view. Whether you are overtaking on the wrong side, however, is black and white, open and shut, and captured on camera.

You do have a choice, its a break pedal. People always seem to forget they have that.
Strictly speaking i would say lane hogging is worse as it has its own offence where as undertaking comes under without due care and attention. Although i think the latter can carry a higher penalty.
Im a sitckler for driving 'properly' on a motorway and middle land driving really irritates me. I dont actively undertake, i follow the flow of traffic, ie in the slowest lane that matches my speed. If i happen to go past someone on the inside because they are in the wrong lane then so be it, always make extra observations just in case they feel suicidal and want to move in and will always ensure ive got somewhere to go (hardshoulder, plenty of space to break) before 'comitting' to an undertake.
I used to play a game called orbiting whilst doing a weekly commute at night. You'd always get a middle lane hogger when the motorway was empty. So i would overtake pull across, slow down and then overtake again and see how many times i could do it until they pulled over in to the 1st lane. My record was 16 times on M62 (i got bored). Ive grown up a bit since those days.0 -
