Hello,
Rec'd a letter today from BW Legal saying their client intends to continue with the claim. And they have filed notice of our client's intention to proceed with the court.
Also rec'd a Notice of Proposed Allocation to the Small Claims Track, that this is now a defended claim and that i must complete the questionnaire by 6th Feb.
I will complete the questionnaire, any advice please or message of support!????!!! Hate the thought of having to go to court, but i will to defend £264.96 which they are saying is the balance due when it was 10p!
We hope you were expecting all of the above, having read bargepole's thread about what happens when (linked in the NEWBIES thread under 'Small Claim?'. This stage is mentioned and how to tick each box, we do not need to cover this again and again on every defence thread (sorry but it is such a minor stage).
More important is your preparation for the stage of your Witness Statement (WS) and evidence; you will get a Notice of Allocation from your local court giving you the date of hearing and the date by which you must file your evidence and WS.
And BW Legal sometimes fold, after frantically phoning or writing to people trying to tell them they ''will lose'' and that they should settle for a smaller 3 figure sum. DON'T! If they do phone you later on, once you have submitted your evidence and WS, you can be sure they are considering folding without any hearing; a last gasp throwing in of the towel is being reported in some well-defended cases.PRIVATE 'PCN'? @TD - do you see yourself more as a Battery Sergeant Major 'Shut Up' Williams, or a Gunner 'Lofty' Sugden? I bet those Concert Party evenings were the mutts' nuts in those days! Actually, I met the Memsahib in Calcutta. I was on the early morning flight from Delhi to Dhaka, carrying Her Majesty's dispatches. The plane was delayed by fog and I missed my onward connection. Just letting the dust settle after you lot with your crazy posts!! I guess its an 'in-joke'?!
Anyhoo - a couple of questions before i send the form N180 back to the CC Business Centre please if anyone can help:
Section A - Am i to agree to this case being referred to the Small Claims Mediation Service or shall i let it go straight to court? If yes to the mediation service, is my offering going to be that i will pay the 10p as ive offered all along?
Section D - About the hearing - Shall i choose a venue near to me, although it says claimants will usually get to choose?
I will not be requesting expert evidence nor inviting witnesses so will just fill my unavailable dates in and thats that?!
Intro letter states - 'and serve copies on all other parties' - do i do that? Do i send a copy of my completed form N180 to BW Legal too?
Sheet at the back of the pack is entitled 'Would you like to settle your case without going to a court hearing?' - You have to answer yes to both statements, statement 1 - am i willing to be flexible (no, its 10p or nothing) and am i willing to listen (yes) and statement 2 do i have enough info about the claim to allow me to enter into negotiations (yes). So do i complete this for the free mediations service?

You do NOT want mediation as these people are clueless and will probably say to pay which saves court time. A mediator is NOT your friend.
Yes you select which court it goes to which will be the nearest to you.
Your case rests on whether the judge considers that BWLegal is acting in a reasonable manner so as you stated in your first post applies
"I chose to pay £3.60 for 4 hours parking in Wakefield, 2 hours parking was something like £2.60.
I still had my ticket and it transpires that I had put my money into the machine, 10p had not registered/dropped through with out me knowing and so a ticket for 2 hours was given for the price of £3.50."
You rightfully expected the machine to be working correctly.
You offered the PPC THE 10p SHORTFALL which they declined
but they never offered to refund the overpayment of 90p
BWLegal are completely mad taking this to court, they really must think that judges are fools
PS: The banter above is our way of some relief when advising about these parking cowboys day after day0
